Tenants Pay the Price When Rent Negotiations Stall Copy link
No one benefits when rent negotiations drag on. Tenants should know what rent applies, property owners must be able to plan their business, and the housing market needs stable rules of the game. Yet late decisions and retroactive rent…
Analysis
Section 23, second paragraph, further provides that the landlord is obliged to repay whatever has been charged in excess, together with interest under Section 6 of the Interest Act (1975:635) from the date of receipt.
A decision on the repayment of rent may not cover a period further back than two years before the application.

Core issue

Tenants in Värmland face a legal situation in which the rent remains undetermined until the dispute is decided by an arbitrator, with retroactive increases as the concrete consequence. The core novelty is that this year's negotiations have become deadlocked; the legal outcome is then determined not by the parties but by the mandatory regime of the Rent Negotiation Act (1978:304). The precise legal question is whether a rent increase can be carried out and enforced without a concluded negotiation agreement, and with what effect in time. The decisive provisions are found in Section 5, which obliges the landlord to initiate negotiations on rent increases on their own initiative, and Section 23, which renders an agreement with the tenant invalid if negotiation under the negotiation procedure has not taken place or if the agreement conflicts with a concluded negotiation agreement. The demarcation between party autonomy and the mandatory system is thus statutorily prescribed, not dependent on negotiation.

Legal assessment

The regulatory framework rests on negotiation procedures arising through agreement or through a decision of the rent tribunal under Section 1 and Sections 9–11.

  • Section 5, first paragraph: the duty to negotiate applies to increases that do not concern optional additions and do not exceed the recommended rent, as well as in the case of a new tenant compared with the previous rent.
  • Section 23: an agreement on rent without a completed negotiation is invalid; the excess amount must be repaid with interest.
  • Section 11 a of the Act (1973:188) concerning agricultural tenancy boards and rent tribunals: in a rent dispute, the rent tribunal may not examine the landlord's claim for a higher rent unless negotiation under the negotiation procedure has taken place — an exception applies where the landlord has called for negotiation but encountered obstacles not attributable to them.
  • Section 14: if the question of extension is unresolved upon the expiry of the procedure, the procedure applies until the question has been finally decided, which prevents the obligations from lapsing during a dispute. The rent tribunal may also, in a repayment matter, determine the rent for continued letting, if the tenant so requests.

Consequences

Realistically, the negotiations in Värmland will move to arbitration or rent tribunal proceedings, and the decision will then come after the year to which the rent relates.

  • Tenants: bear uncertainty about the rent throughout the year and the risk of retroactive increase when the decision is issued; the protections are the two-year limit on repayment and the invalidity rules of Section 23.
  • Property owners: revenues remain unclear for large parts of the year, which, according to the debate article, risks undermining maintenance and housing investments.
  • The parliamentary parties: the article's author calls for reform of the dispute resolution system — a statutory right to refer disputes to an arbitrator without special agreements, a limited negotiation period, simplified handling in the rent tribunal, and decisions based on objective economic criteria.
  • Practical significance: applies to all rent negotiations under a negotiation procedure in the country; the Act does not cover cooperative tenancy under Section 1.

Section 2 of the 1978 Rent Negotiation Act (hyresförhandlingslagen, "the 1978 Act") defines the negotiation clause as a provision in a lease whereby the tenant agrees to be bound by the terms of the lease, in particular regarding the rent, as accepted by the association conducting the negotiations. It provides that this clause is introduced or retained if this is not unreasonable, having regard to the tenant’s standard of living and his opinion and to the opinion of other tenants affected by the clause.

Analysis

Correction. The article claims that the Gambling Act requires information to be "limited to facts about the lottery and presented as factually as possible" – this is an incomplete rendering of the requirements: under the Gambling Act, a licence holder must keep all relevant information about the game, including the chances of winning and the rules, easily accessible to players and authorities, so the requirement is not about restricting information to "mere facts" but about the full availability of essential information. Furthermore, the article implies that KO is bringing proceedings for "breaches of the Gambling Act" in general; the correct position is that only marketing that contravenes Chapter 15, Sections 1–2 is deemed unfair to consumers when applying Sections 5, 23 and 26 of the Marketing Act – it is this linkage that gives the Patent and Market Court jurisdiction, not the Gambling Act as such.

Under Chapter 15, Section 4 of the Gambling Act, marketing that contravenes Section 1 shall, upon application of Sections 5, 23 and 26 of the Marketing Act (2008:486), be regarded as unfair to consumers.
One concrete precedent in the record is the Advea case, in which the Patent and Market Court linked an interim conditional fine totalling SEK 3.5 million to its decision against the credit broker.

Core issue

Svenska Postkodföreningen now awaits a substantive ruling from the Patent and Market Court on whether a single Instagram advertising video may be deemed to contravene the moderation requirement of the Gambling Act. The Swedish Consumer Agency (KO) is seeking not only an injunction against the video, but also a conditional fine, the amount of which is linked to lottery revenues of more than SEK 3.5 billion according to the 2025 annual report. The legal situation awaiting determination therefore comprises, on the one hand, a principled examination of Chapter 15, Section 1 of the Gambling Act (2018:1138), and, on the other, a sanctions issue with potentially significant financial weight. The precise legal question is whether, upon an overall assessment, the marketing presents the lottery as socially attractive and creates a sense of urgency — and is therefore not moderate. Chapter 15, Section 1 requires that moderation be observed in the marketing of gambling to consumers, and the marketing must not be specifically directed at persons under 18 years of age.

Legal assessment

KO's objection concerns two specific elements of the video: the portrayal of participation as socially attractive and the time-limited half-price offer with a final purchase date, which, according to the statement of claim, creates an impression of urgency. According to KO, the Gambling Act requires that the information be limited to facts about the lottery and presented as factually as possible. According to the statement of claim, the video features falling winning cheques, SEK 101 million in gold-coloured text, and a link to the lottery's website.

  • The Court's jurisdiction: The Patent and Market Court examines injunctions with conditional fines under the sanction system of the Marketing Act. Case law is sparse, particularly in respect of social media. This demonstrates that the Court is willing to impose substantial conditional fines in KO cases. On the political front, in autumn 2022 the Riksdag rejected the proposal in the bill *En förstärkt spelreglering* (An Enhanced Gambling Regulation) concerning an adjusted moderation requirement, on the grounds that case law was in the process of becoming established. The Swedish Consumer Agency's general guidelines on the marketing of gambling from 2025 are merely advisory; a court ruling would carry greater weight.

Consequences

For Postkodlotteriet, what is at stake is an injunction against the video, coupled with a conditional fine the amount of which the Court will set with lottery revenues of more than SEK 3.5 billion as its benchmark. A ruling would have repercussions far beyond the individual advertiser, as it would establish what the moderation requirement entails for gambling marketing on social media in short, visual and algorithmically distributed formats.

  • Scenario 1: The Court enjoins the marketing and imposes a high conditional fine — the gambling industry receives a norm-setting interpretation of moderation applicable to Instagram and similar platforms.
  • Scenario 2: The Court dismisses KO's claim — case law on moderation for social media remains undefined, and the regulatory issue may resurface politically.
  • Practical significance: all licence holders who market gambling on social media, because precedent from the Patent and Market Court carries more weight than the Swedish Consumer Agency's general guidelines.

Correction. [PRAKTINE_REIKSME]: The argument of community of interest between the property owner and the letting company is now a strong tool for tenants who have paid excess rent in subleases arranged through companies — it should be pleaded together with the requirement that the arrangement was used to circumvent security of tenure and reasonable rent rules. For property owners who let through their own or affiliated companies, the risk is concrete: terminating the tenant's lease may be ineffective against the tenant, who can demand to be treated as a direct first-instance tenant vis-à-vis the owner, including a right to repayment of excess rent. Letting structures with an intermediate company should therefore be documented and designed so that the community of interest cannot be invoked as evidence of circumvention.

In such a situation, the tenant has the same rights vis-à-vis Zlatan and Helena Seger as if they had let the tenancy directly to him.
The Court of Appeal shared the assessment that there is a community of interest between, on the one hand, Zlatan Ibrahimović and Helena Seger and, on the other hand, the rental company, vis-à-vis the tenant.

Core issue

The legal position is now final: the tenant may remain in the premises with the same security of tenure as a first-hand tenant, since the Supreme Court has refused Ibrahimović and Seger leave to appeal, and the Court of Appeal's judgment therefore stands. The couple has, in effect, lost their attempt to terminate the lease. The legal core of the case is a straw-man (bulvan) arrangement: the apartment was let through a rental company with a community of interest with the property owners, in order to circumvent the protective rules of tenancy legislation. The courts applied the principle that where a legal relationship is exploited to circumvent provisions on security of tenure and reasonable rent, the tenant acquires the same position as if the letting had been made directly. The regulatory framework for such arrangements is found in Chapter 12 of the Land Code; the Act (1985:277) on Certain Straw-Man Relationships does indeed govern straw-man arrangements, but primarily concerns ownership and the acquisition of real property, not tenancy relationships. In this case, it was the protective provisions of Chapter 12 of the Land Code — security of tenure and reasonable rent — that the courts protected by giving them full effect.

Legal assessment

The District Court emphasised that it could be assumed that the legal relationship had been exploited to circumvent the beneficial provisions of tenancy legislation; this gave the tenant the same rights as upon a direct letting.

  • The Court of Appeal found a community of interest between Ibrahimović/Seger and the rental company vis-à-vis the tenant; the couple's new arguments did not alter that assessment.
  • The tenant invoked Supreme Court case law on straw-man arrangements and asserted that he had paid excessive rent under an arrangement that benefited the property owners.
  • The Supreme Court's refusal to grant leave to appeal means that the Court of Appeal's application of the principle of circumvention of Chapter 12 of the Land Code is now binding in the case.
  • Under the Act (2012:978) on the Letting of One's Own Dwelling, Chapter 12 of the Land Code applies in the first instance, and terms to the tenant's disadvantage are of no effect (Section 2) — which reinforces the protection against such arrangements.

Consequences

The tenant may remain in the premises with the rights of a first-hand tenant; the notice of termination from Ibrahimović and Seger is of no effect to the extent it is based on the circumventing arrangement.

  • Excessive rent paid may, according to the tenant's claim, be subject to repayment, since the principles on reasonable rent then apply in full.
  • For property owners who let through intermediaries, the judgment means that straw-man arrangements do not shield against security of tenure; the risk is that the tenant will be treated as a direct tenant.
  • For tenants in comparable situations, the outcome strengthens the possibility of invoking community of interest and circumvention already at the District Court stage.

Correction. The article quotes the counsel, Roland Sjölin, as saying that by virtue of the Supreme Court's decision the tenant "receives the same protection as a direct tenant", which may be misunderstood to mean that subtenants generally enjoy this protection. This is not consistent with the statutory text: the Act (2012:978) on Letting of One's Own Dwelling expressly does not apply to the grant of a tenancy in sublease form, so an ordinary sublease agreement does not confer a right to extension or equivalent protection. The correct reasoning is that the protection in this case derives from the courts having seen through a front arrangement – a special circumstance in which the intermediary is regarded as acting on behalf of the real landlord – and not from the fact that subletting as such confers direct-tenant protection.

This means that he has the right to remain in the apartment with the same rights as a first-hand tenant.
For the Ibrahimovic/Seger couple, a liability remains to pay a total of SEK 422,000 in costs of proceedings before the District Court and the Court of Appeal.

Core issue

The final legal position for the tenant is now settled: the Court of Appeal's judgment has acquired legal force, as the Supreme Court refused leave to appeal. The central legal question has been whether a second-hand tenant in a straw-man arrangement can invoke tenancy protection directly against the property owner. The District Court and the Court of Appeal found that the couple had let the property through an intermediary in order to circumvent the Tenancy Act, and the tenant is therefore equated with a first-hand tenant. The underlying material refers to a "much-discussed straw-man judgment" of the Supreme Court as precedent for this assessment, as well as to the Land Code (1970:994) as the framework governing the tenancy relationship.

Legal assessment

The parties' positions follow from the final judgment:

  • The tenant has the same protection as a first-hand tenant, which, according to his counsel, strengthens his position in the parallel proceedings before the Rent and Tenures Tribunal, where he has been given notice of termination.
  • The landlords are to compensate the tenant's costs of proceedings in the amount of SEK 422,000.
  • The matter before the Rent and Tenures Tribunal has not yet been decided; the validity of the notice of termination is to be examined separately there.

As regards the assessment of notices of termination in general, Chapter 4 of the Land Code contains limited grounds for termination, and an application to a court for the termination of the tenancy relationship under Chapter 5, Section 16 (cf. also Section 10 of the Private Letting Act (2026:772)) constitutes a notice of termination once service has been effected in the prescribed manner. Upon a change of ownership, the purchaser may, under certain circumstances, terminate tenancy rights listed in the register of owners' holdings pursuant to the Enforcement Code (1981:774) within one month from the date of taking possession; if the purchaser does not do so, the agreement remains binding on the purchaser. In this case, the couple instead chose to terminate the letting company in 2023, which resulted in the termination of all tenants. The underlying material contains no specified case numbers other than the aforementioned straw-man judgment of the Supreme Court, which was applied by the District Court.

Consequences

The tenant may remain in the apartment; the judicial proceedings have concluded after three years.

  • The couple is to pay SEK 422,000 in costs of proceedings.
  • The pending decision is that of the Rent and Tenures Tribunal in the termination matter, which, according to the underlying material, has not yet been decided.
  • By virtue of the judgment's equating of the tenant with a first-hand tenant, the tenant's counsel considers that his prospects before the Rent and Tenures Tribunal have improved.
  • For the market, the outcome signals that straw-man arrangements do not protect property owners seeking to circumvent the protective provisions of the Tenancy Act.

to submit reports pursuant to Section 8 no later than 1 June (January–April), 1 October (May–August) and 1 February (September–December);
those not engaged in lobbying must nonetheless submit a nil report.

Core issue

As of 1 July 2027, a statutory registration obligation will apply to those who professionally seek to influence decisions of the Riksdag and the Government. The news that the Riksdag has approved a lobby register means that active lobbyists must register with the Swedish Companies Registration Office (Kammarkollegiet) and thereafter report their contacts on a periodic basis. The precise legal question is who is covered by the registration and reporting obligations under the Act (2026:1459) on Transparency in Communication Intended to Influence Political Decisions. Decisive is the definition of influence communication in Section 2 of the Act: contact with a political decision-maker or that person's staff for the purpose of influencing the preparation or decision in a matter before the Riksdag or the Government, in order to promote a particular interest or outcome. Engagements to provide advice or support ahead of such contact are also covered, pursuant to the second paragraph of the same section.

Legal assessment

The registration obligation applies to legal persons and sole traders engaged in influence communication, pursuant to Section 4. The obligation is, however, limited by the exemptions in Section 5; it does not, inter alia, apply to sole traders whose principal activity is of another kind, public authorities, other states and the EU, or political parties holding mandates and their affiliated organisations. Exemptions also apply to ordinary administrative matters with authorities and to participation in government-appointed working groups or inquiries where such participation is documented. A registered person who has merely provided advice or support to another is, according to the source material, exempt from providing certain key information in the report.

  • Obligations of the registered person:
  • to register with Kammarkollegiet, which also serves as the supervisory authority;
  • in the report pursuant to Section 9, to specify the subjects, the names of the decision-makers or ministries concerned, the unit, committee, method of contact and scope;
  • to identify the client where the communication was carried out on behalf of another;
  • even where no influence communication has taken place during a period, to submit a report stating this, pursuant to Section 10.

The political decision-makers defined in Section 3 are members of the Riksdag and government ministers; staff include, inter alia, political secretaries, employees of the Riksdag Administration, state secretaries, political advisers, as well as special inquiry chairs and committee members. The source material contains no case law on the Act, which has not yet entered into force. The criticism from Annika Hirvonen of the Green Party – that the register should also cover contacts not tied to a specific decision, such as agreements like the Tidö Agreement or the January Agreement – did not gain support in the Riksdag.

Consequences

For tobacco lobbyists and other interest organisations, the Act means that contacts with the Riksdag and the Government in decision-making matters will be publicly reported, which is precisely the transparency tool that Tobaksfakta has called for.

  • The politicians themselves are not registered; the obligation rests entirely on the party conducting the influence communication.
  • The source material contains no sanction provisions; the penalties applicable in the event of non-compliance therefore cannot be determined on the basis of the sources.
  • Next step: the Act enters into force on 1 July 2027; before then, Kammarkollegiet must be prepared to receive registrations, and the first reports from registered persons are expected thereafter in accordance with the periodic schedule in Section 8.

Who Runs Osby? Well, Nobody Copy link
The municipality's services to residents are hardly any better than in other municipalities, so how can tax rates be 10 percent lower in Östra Göinge or 15 percent lower in Örkelljunga? And why does the municipality have 10 percent more…
Analysis
Section 1, Chapter 7 provides that the board shall appoint a director holding "the leading position among the employees"; Section 2, Chapter 7 requires the board to issue an instruction determining how the director shall manage the administration.
Under Section 3, Chapter 3 of the Local Government Act, the municipal council shall decide on "organisation and forms of activity"; questions of reorganisation or reducing the number of employees therefore cannot be decided by the municipal director alone.

Core issue

The pending situation for Osby Municipality is not a sanction, but a governance responsibility: under the law, the municipal council and the municipal executive board bear responsibility for organisation, finances and follow-up, while officials can be held accountable only politically and through their terms of employment (instruktion). The submission is a debate piece questioning organisational costs; it does not trigger any compulsory procedure against the municipality. The precise legal question is who, under the Local Government Act (2017:725) (Kommunallagen), holds the competence to decide on the municipality's organisation and staffing levels — and who can be held accountable if the costs are considered unjustified. Decisive above all are Chapter 4, Sections 2–3 (the council's competence), Chapter 6, Sections 6 and 13 (the board's management and supervisory duties) and Chapter 7, Sections 1–2 (the municipal director's position and instructions).

Legal assessment

  • Section 6, Chapter 6 places on the executive board the duty to "direct and coordinate the administration" and to supervise the activities of the committees.
  • Sections 12–13, Chapter 6 give the board the right to request opinions and information from other committees and employees, and impose the duty to manage financial administration and implement the council's decisions.

The director's mandate is thus a delegation from the board, not an independent accountability vis-à-vis the citizens.

  • Section 3, Chapter 7 makes the director ineligible for positions of public trust within the municipality — a clear separation of powers between politics and administration.
  • Section 2, Chapter 4 opens the possibility for the council to adopt provisions on who shall hold the title of municipal commissioner (kommunalråd); the rules on the number of full-time municipal commissioners rest with the council itself, and the objection regarding "2 full-time municipal commissioners" can therefore be directed only against the council's own decision.
  • Under Section 7, Chapter 6, the committees may not exercise supervision over their own activities — the supervisory assessment rests with the executive board.
  • Nothing in the material shows that limits on staff numbers or tax rates are prescribed by law; the comparisons with Östra Göinge and Örkelljunga are economic, not legal, and there is no case law in the material to cite.

Consequences

For the municipality's citizens, the practical route is to raise the matter with the municipal council, which decides on organisation under Section 3, Chapter 3 — a motion or interpellation at the next meeting are viable avenues.

  • The executive board may, if it finds reason, under Section 12, Chapter 6 request information on staffing developments and have the central administration reviewed; the auditors may, under Section 18, Chapter 6 (cf. Chapter 6 on auditing), review whether the activities are conducted satisfactorily.
  • If the council finds that positions of public trust are being misused, the question of discharge from liability (ansvarsfrihet) under Section 7, Chapter 3 may be raised at the annual decision — a political, not legal, aftermath.
  • Realistically, the debate will continue in political bodies; no authority in the material has supervision over the municipality's staffing levels.

Improve animal welfare and phase out the fast-growing broiler chicken Copy link
Katarina Erlingson is a writer at the Liberal News Agency. Photo: Liberal News Agency. Sweden has long been a pioneer in animal welfare, but resting on past achievements is not enough. The question is how good Sweden really is these days…
Analysis
Under SJVFS 2015:29 Section 6, broiler chickens with an average growth rate of no more than 45 grams per day are considered slow-growing for the application of Article 12.5 of Commission Regulation (EC) No 889/2008.
Under SJVFS 2019:23 Section 9, broiler chickens must have a dark period of at least six hours per day, of which at least four consecutive.

Core issue

Poultry producers are not facing any new legal situation today – Ross 208 is still permitted, since none of the cited rules prohibit fast-growing breeds. The core of the news is that a political demand for a ban has been raised in the middle of an election campaign, but such a ban does not yet exist in the Animal Welfare Act (2018:1192) or in the regulations of the Swedish Board of Agriculture. The precise legal question is therefore: by means of which existing rules can the keeping of fast-growing broiler chickens be controlled or restricted at all? Decisive in this regard are the Animal Welfare Act (2018:1192), the Animal Welfare Ordinance (2019:66) and SJVFS 2019:23 on the keeping of poultry in agriculture, as well as – for organic production – SJVFS 2015:29 with the amendments SJVFS 2015:51 and SJVFS 2017:10.

Legal assessment

Under SJVFS 2019:23 Section 9, broiler chickens must, except during the first week of rearing and the last three days before slaughter, have a dark period of at least six hours per day, of which at least four consecutive.

  • The same regulation requires that the lighting on at least 80% of the floor area be at least 20 lux at the birds' eye level; on veterinary advice, the light intensity may be temporarily reduced.
  • SJVFS 2019:23 Section 10 prohibits conveyor belts for automatic collection that are used in such a way that the animals suffer or are injured.
  • The threshold for what counts as slow-growing exists only in organic law: under SJVFS 2015:29 Section 6 (unchanged in SJVFS 2015:51 and SJVFS 2017:10), broiler chickens with an average growth rate of no more than 45 grams per day are considered slow-growing for the application of Article 12.5 of Commission Regulation (EC) No 889/2008.
  • Ross 208, slaughtered at 35 days, exceeds that rate; outside organic production there is no corresponding growth limit in the material.
  • Permit matters under Chapter 6, Section 4 of the Animal Welfare Act (2018:1192) are examined by the County Administrative Board under the Animal Welfare Ordinance (2019:66), and the Swedish Board of Agriculture may issue regulations on exemptions and on what counts as commercial activity.
  • Official animal welfare controls are governed by SJVFS 2019:14: official veterinarians must specifically verify compliance with Regulation (EC) No 1/2005, Chapter 2, Section 13 and Chapter 5, Section 1 of the Animal Welfare Act (2018:1192), as well as SJVFS 2019:8 on slaughter and other killing and Council Regulation (EC) No 1099/2009.
  • Under SJVFS 2019:14 Section 16, establishments with animals kept for food production must pay a fee for additional official controls pursuant to Article 28 of Regulation (EC) No 882/2004.
  • The material contains no case law; the debate about Djurens Rätt's night-time filming and Svensk Fågel's disavowal is an evidentiary matter, not a precedent.
  • Imports and exports of poultry are governed by SJVFS 2000:172/2000:173: day-old chicks must originate from a flock that has been isolated for 14 days and tested free from salmonella, or have undergone an equivalent control programme approved by the Commission.

Consequences

Without new legislation, county administrative boards may intervene only if existing requirements – dark period, lighting, handling – are breached during official animal welfare controls under SJVFS 2019:14.

  • A ban on fast-growing breeds would require an amendment to the Animal Welfare Act (2018:1192) or new regulations from the Swedish Board of Agriculture; no such decision exists in the material.
  • Producers converting to slow-growing breeds (no more than 45 grams per day) may use this in marketing, but in organic production must at the same time comply with the rules of Regulation (EC) No 889/2008.
  • There is a risk of increased imports according to the news; imported poultry must satisfy the salmonella requirements of SJVFS 2000:172, including 14 days of isolation and testing.
  • For trade and consumers, the practical consequence is that prices may rise upon conversion, which Coop Norway exemplifies in the Norwegian phase-out.
  • The 2026 election campaign makes political consideration of the demand the most immediately anticipated development.

Injured boy in Fagersta: My whole body is destroyed Copy link
In the school attack at Brinellskolan, a 17-year-old girl was killed and three students were injured, one of them seriously. "First he stabbed me in the stomach, he cut my chest twice," the boy tells Ekot.
Analysis
The amount cap under Section 14 is twenty price base amounts for personal injury paid as a lump sum, or three price base amounts per year where an annuity is awarded.
Since the injured party is 16 years old, his claim is subject to limitation at the earliest on the day he turns 21, pursuant to Section 19 of the Crime Victim Compensation Act.

Core issue

The severely injured 16-year-old faces a state-funded compensation process, not merely a question of damages from the perpetrator. Since Liam Nebel is likely insolvent, crime victim compensation under the Crime Victim Compensation Act (2014:322) becomes the realistic route to compensation for the near-fatal injury. The attack on 21 August 2025 at Brinellskolan is an intentional violent crime in Sweden, satisfying the basic conditions in Section 2 of that Act. The precise legal question is which heads of damage are compensated by the State and in what amount, and this is determined by Sections 4, 5, 13 and 14 of the Crime Victim Compensation Act together with Chapter 5 of the Tort Liability Act (1972:207).

Legal assessment

The boy may apply for compensation for personal injury under Section 4 of the Crime Victim Compensation Act, which also covers damage to the clothing and glasses he was wearing at the time of the injury.

  • Compensation for personal injury is determined in accordance with Sections 1–3 of Chapter 5 of the Tort Liability Act; future loss of income may be paid as a lump sum or as an annuity, where an annuity requires that it be of substantial significance for future care or support (Section 13).
  • The serious violation constituted by an attack on the person is compensated under Section 5 of the Crime Victim Compensation Act, with the amount determined in accordance with Section 6 of Chapter 5 of the Tort Liability Act.
  • Under Section 10 of the Crime Victim Compensation Act, damages, insurance compensation and foreign state compensation already paid are to be deducted.
  • Upon payment, the State is subrogated to his right of recourse against the perpetrator up to the amount paid, plus interest under Section 28; the authority notifies the Swedish Enforcement Authority pursuant to Section 5 of the Crime Victim Compensation Ordinance.

Consequences

In practice, an application procedure before the Swedish Crime Victim Compensation Authority awaits, where the boy's mother, as his guardian, may apply on his behalf; children under 18 must have the participation of both guardians, subject to exceptions under Section 18.

  • The fact that Liam Nebel has been prosecuted and convicted facilitates the assessment, but a judgment is not a requirement — a police investigation suffices as an investigation into how the injury was caused.
  • The State's recourse claim against the perpetrator may be waived in whole or in part if there are exceptional reasons (Section 28, second paragraph).
  • Should the authority offer an oral hearing, travel and subsistence may be reimbursed from public funds, with a possible advance payment.

The prosecutor's choice of charge – attempted murder rather than incitement to suicide – is what is now at stake, since the sentencing ranges differ dramatically and the judgment will provide guidance for future prosecutions in internet-related crime where the perpetrator acts from abroad.

Core issue

The 18-year-old suspect awaits a verdict in the district court for more than 70 offences committed in several countries, perpetrated after he turned 18 or, where committed earlier, under the special rules of juvenile law. Since the arrest took place in April 2025 and he is now 18, the case is marked by the delimitation between the ordinary penalty system of the Penal Code (1962:700) and the Special Provisions on Young Offenders Act (1964:167), which under its Section 1 applies when the suspect has not reached the age of eighteen. The central legal question is whether remotely directing another person to harm themselves can constitute attempted murder or aggravated assault; this is determined by the application of Chapter 3 of the Penal Code (murder and manslaughter) and Chapter 3, Section 5 (aggravated assault), respectively, to acts committed without physical presence. The charges include, among other things, three counts of attempted murder, incitement to suicide, rape, aggravated sexual offences against children under Chapter 6, Section 4 of the Penal Code, and aggravated cruelty to animals, all of which are to be examined individually. His denial of the offences means that the district court must fully examine both the descriptions of the acts and the intent for all of the more than 70 offences.

Legal assessment

The district court's jurisdiction and the procedure follow the Code of Judicial Procedure concerning criminal trials, together with the special procedural rules laid down in the Special Provisions on Young Offenders Act (1964:167) for cases where the suspect was under 18 at the time of the offence. The materials contain no case law resolving the remote-conduct question, which explains why the case is described as unique. However, the materials highlight the regulatory framework surrounding young offenders, which becomes relevant depending on when the offences were committed:

  • Under the Penal Code, the penalty range for attempted murder and aggravated assault is imprisonment of ten years or life imprisonment, and imprisonment of at least two and at most ten years, respectively; the materials indicate that because the penalty ranges exceed five years in the applicable provisions, forfeiture may be considered.
  • Since the offences were allegedly committed in part in several countries, the question of Swedish jurisdiction under Chapter 2, Sections 1–3 of the Penal Code (territorial and extended jurisdiction) is raised. The 18-year-old appears as the accused defendant in an ordinary criminal trial, and the prosecutor has chosen to characterise the offences as "grave and particularly ruthless", which constitutes grounds for increased punishment under the Penal Code's gravity assessments. His denial of the offences means the case cannot be resolved through a shortened procedure. The verdict will be delivered on Thursday.

Consequences

The practical significance of the judgment will be greatest for the development of Swedish law regarding remote acts: should the district court uphold the prosecutor's construction, acts committed online without physical presence may be qualified as attempted murder or aggravated assault. This will also bear on how phenomena resembling the online cult 764 can be combated in the future, since a judgment with a penalty range exceeding five years' imprisonment opens the door to coercive measures under the provisions on serious criminality in the Special Provisions on Young Offenders Act (1964:167), as well as to the enforcement of Swedish decisions in the other affected countries. Injured parties who have been subjected to the aggravated sexual offences against children under Chapter 6, Section 4 of the Penal Code may, in the event of a conviction, claim, inter alia, damages. In the event of an acquittal, several injured parties in other countries would have to rely on separate prosecution proceedings in their home countries.

criminal responsibility (see, mutatis mutandis, T. v. the United Kingdom [GC], no. 24724/94, § 72, 16 December 1999). The Court further considers that the duty to investigate offences committed by juvenile offenders who are above the age of criminal responsibility may not always require resorting to criminal proceedings in view of the need to strike the right balance between the protection of society, including the victim, and the best interest of the child offender (see paragraphs 22-23 above).

Analysis
Under Section 15, the sanctions are limited to a warning and a salary deduction, where a salary deduction may be made for a maximum of thirty days and may amount to no more than 25 percent of daily pay per day.
Under Section 17, the procedure requires that the employee has been notified in writing within two years of the offense.

Core issue

Police officers who commit service-related misconduct — such as negligent discharges or forgotten weapons — face two parallel tracks: disciplinary proceedings within the agency and a potential criminal investigation. National Police Commissioner Petra Lundh has announced that the Swedish Police Authority is reviewing its disciplinary measures system, which may raise the threshold for when a warning or salary deduction is imposed. The core legal question is when a service-related offense warrants disciplinary sanction, and how the disciplinary track relates to a potential preliminary criminal investigation. The rules are set out in the Act (1994:260) on Public Employment. Under Section 14, a disciplinary sanction may be imposed when an employee intentionally or negligently breaches their employment obligations; if the fault is minor, no sanction may be imposed. For police officers, additional reporting and notification obligations apply under the Police Ordinance (2014:1104): under Section 13, a police officer must report to their superior if anyone is injured as a result of an intervention, provided the injury is not insignificant.

Legal assessment

The application is divided into two proceedings with different bodies and different thresholds.

  • Disciplinary measures: The Swedish Police's Personnel Responsibility Board (PAN) decides on employment-related disciplinary measures under Sections 14–15 of the Act on Public Employment (LOA). The procedure requires that the employee has been notified in writing within two years of the offense under Section 17; a disciplinary sanction may not be imposed after the employment has ended under Section 19.
  • Criminal investigation: The Ordinance (2014:1106) on the Handling of Cases Concerning Crimes Committed by Employees within the Police regulates when a preliminary investigation is to be handled under a special track, including where an employee is alleged to have committed a crime in connection with their employment or acted improperly in the exercise of public authority (Section 2). Preliminary investigations are handled by the Special Prosecutor's Chamber, and decisions to discontinue are made by prosecutors under Section 3.
  • Interaction: Under Section 18 of the LOA, the employer may not commence or continue disciplinary proceedings once a measure has been taken for the purpose of prosecution; after criminal proceedings, it is required only that the act was not considered a crime for a reason other than insufficient evidence.
  • Obligation to report for prosecution: Under Section 22 of the LOA, a person reasonably suspected of a crime in their employment must be reported for prosecution for certain offenses under the Penal Code. The article shows that most cases remain at the disciplinary stage. This means that a police officer who has forgotten a weapon typically risks a warning or salary deduction — not prosecution — while more serious cases may be referred to the Special Prosecutor's Chamber.

Consequences

If the National Police Commissioner's review results in a raised threshold for disciplinary sanctions, the following scenarios may materialize:

  • Fewer cases of negligent discharges and forgotten weapons will reach PAN, since minor cases under Section 14 of the LOA may not be sanctioned — the threshold for what is considered minor may be raised internally.
  • The willingness to report will increase, giving the agency a better basis for addressing systemic failures in weapons handling.
  • Prosecutions for misconduct in office will remain uncommon, since Section 22 of the LOA and the Ordinance (2014:1106) nonetheless govern which crimes must be reported for prosecution.
  • For police officers, the practical consequence of a disciplinary sanction is limited financially: a maximum of 30 days' salary deduction at no more than 25 percent of daily pay, or a warning.
