Tenants Pay the Price When Rent Negotiations DeadlockCopy link
No one benefits when rent negotiations drag on. Tenants need to know what rent applies, property owners must be able to plan their operations, and the housing market needs stable rules. Yet late decisions and retroactive rent increases…
Analysis
Correction. The article presents the arbitrator as the obvious end point when negotiations reach deadlock: “When negotiations no longer make progress, the only remaining option in the end is to allow an independent arbitrator to decide the matter.” This is incomplete, because a right to arbitration under the Rent Negotiation Act requires the parties to have agreed that an arbitrator may examine the dispute. The Rent Tribunal appoints an arbitrator upon application only where such an agreement exists. The article also fails to mention that the ordinary dispute resolution route in the absence of such an agreement is the Rent Tribunal, which is precisely why the opinion piece itself proposes a legislative amendment giving landlords a “statutory possibility to refer a dispute to an arbitrator without the need for special agreements”. A correct formulation would be that arbitration is a possible but agreement-dependent form of dispute resolution, and that the proposal in the article is in reality aimed at abolishing that very agreement requirement.
If a negotiation order is terminated, the opposing party has the right to refer the issue of extension to the Rent Tribunal, with an application to be submitted within three weeks (section 13).
The landlord is then obliged to repay the amount received together with interest under section 6 of the Interest Act (1975:635) from the date of receipt.
Core issue
The author seeks to change the very machinery of the Rent Negotiation Act (1978:304), not merely to negotiate more effectively. The item is an opinion piece by Fastighetsägarna Värmland; in Värmland, this year’s rent negotiations have deadlocked without agreement. The legal position now facing the parties is arbitration: where negotiations no longer progress, the article states that the remaining option is to allow an independent arbitrator to determine the rent issue. In the meantime, the legal position under section 14 of the Rent Negotiation Act applies: if the issue of extending the negotiation order has not yet been decided when the order would otherwise have ceased to apply, it continues to apply until the matter has been finally determined. The precise legal issue is whether a landlord may refer a rent dispute to an arbitrator without a separate agreement, and whether the negotiation period may be limited. At present, this is governed by the Rent Negotiation Act (1978:304) and the Act (1973:188) on Leasehold Tribunals and Rent Tribunals; any amendment requires a decision by the Riksdag, not a local agreement.
Legal assessment
Under section 5 of the Rent Negotiation Act, a negotiation order imposes an obligation on the landlord to negotiate rent increases on its own initiative, subject to the stated exceptions for optional additions and recommended prices. The role of the Rent Tribunal is limited but significant. Under section 11 a of the Act (1973:188) on Leasehold Tribunals and Rent Tribunals, the tribunal may not, in a rent dispute, examine the landlord’s claim for higher rent unless negotiations under the negotiation order have taken place in relation to the disputed issue; an exception applies where the landlord has requested negotiations but has encountered an impediment through no fault of its own. The material contains no case law, so no judicial authorities can be invoked. The central point of the article is that these rules contain no sanction against a party that allows negotiations to drag on; according to the material, there are therefore weak incentives to reach agreement in time.
Consequences
Realistic scenarios for tenants and landlords in Värmland:
Continued uncertainty regarding the applicable rent for large parts of the year, because the decision will come after the turn of the year.
Risk of retroactive rent increases once an arbitrator or final agreement provides a determination; retroactive adjustment is regulated, among other provisions, in Chapter 12, sections 55 e et seq. of the Land Code.
For property owners: uncertain revenues while operating and maintenance costs increase, which, according to the article, risks adversely affecting investment in maintenance and new housing.
Politically: the article urges the parliamentary parties to reform the law on dispute resolution in collective rent negotiations, calling for a statutory right to refer disputes to an arbitrator, a limited negotiation period, simplified proceedings before the Rent Tribunal, and arbitral decisions based on objective economic criteria.
The next step in the specific procedure: if the parties in Värmland do not reach agreement, the dispute will be referred to an arbitrator for determination. At national level, a legislative initiative in the Riksdag may follow, but the material indicates no timetable for this.

16. Section 2 of the 1978 Rent Negotiation Act (hyresförhandlingslagen, "the 1978 Act") defines the negotiation clause as a provision in a lease whereby the tenant agrees to be bound by the terms of the lease, in particular regarding the rent, as accepted by the association conducting the negotiations. It provides that this clause is introduced or retained if this is not unreasonable, having regard to the tenant’s standard of living and his opinion and to the opinion of other tenants affected by the clause.
Consumer Ombudsman sues Postcode Lottery, seeks ban on aggressive Instagram advertisingCopy link
Sweden’s Consumer Ombudsman has filed a lawsuit against Svenska Postkodföreningen in the Patent and Market Court over a single Instagram ad, but its broader aim is to clarify what the Gambling Act’s requirement for moderation means when…
Analysis
Correction. The article states that “the Gambling Act requires the information to be limited to facts about the lottery and presented as objectively as possible”. This is incomplete: the moderation requirement in Chapter 15, Section 1 is a general duty of care, and the statutory wording contains no express requirement that information be “limited to facts about the lottery” in those terms. On the contrary, Chapter 15 provides that commercial communications concerning gambling must contain clear information on the minimum age for gambling and that the licence holder must provide further mandatory information under Sections 3 and 3a. This is therefore a minimum requirement for certain information, not a maximum prohibition on other content. The article further states that the Patent and Market Court “may set conditional fines for breaches of the Gambling Act” without mentioning the qualification: the court’s jurisdiction in the field of patent and market law covers certain prescribed statutes, and the sanction for certain breaches of the Gambling Act is specifically regulated as a market disruption fee under Sections 29-36 of the Marketing Act, a fee level that differs from a competition-based conditional fine in marketing-law proceedings.
Breaches of the marketing rules in Chapter 15, Sections 2 and 4 are deemed unfair to consumers for the purposes of Sections 5, 23 and 26 of the Marketing Act pursuant to Section 4 of the same chapter of the Gambling Act, thereby opening the way for prohibitions and conditional fines.
In the Consumer Ombudsman’s case against the credit intermediary Advea, the Patent and Market Court attached an interim conditional fine totalling SEK 3.5 million to its decision.
Core issue
Svenska Postkodföreningen is awaiting a hearing on the merits before the Patent and Market Court, where a single Instagram advertising video could result in a prohibition subject to a conditional fine, with the amount potentially scaled by reference to lottery revenues of just over SEK 3.5 billion (2025 annual report). The pending legal issue is therefore not a fine, but a procedural prohibition order subject to a conditional fine under the Marketing Act (2008:486), linked to the marketing rules in the Gambling Act (2018:1138). The precise legal question is whether the video, featuring raining prize cheques, gold-coloured text referring to SEK 101 million, and a time-limited half-price offer, breaches the moderation requirement in Chapter 15, Section 1 of the Gambling Act. That provision requires moderation in the marketing of gambling to consumers and prohibits targeting persons under the age of 18. The Swedish Consumer Ombudsman’s action is deliberately intended to establish precedent: in autumn 2022, the Riksdag rejected the bill *A Strengthened Gambling Regulation* on the ground that case law should first be established.
Legal assessment
The Consumer Ombudsman’s assessment rests on an overall evaluation of two elements in the video. The Consumer Ombudsman argues that the lottery is presented as socially attractive, as something in which everyone ought to participate, and that the time-limited offer creates urgency to purchase.
According to the statement of claim, the video shown contains prize cheques over a residential neighbourhood, the prize amount of SEK 101 million in gold-coloured text, a half-price offer with a final purchase date, and a link to the lottery’s website.
The Consumer Ombudsman seeks a prohibition subject to a conditional fine and refers to the annual report’s SEK 3.5 billion in lottery revenues as an argument for an increased level; the amount has not been made public. The Swedish Consumer Agency’s general guidelines on gambling marketing (2025) provide guidance but are not binding; a court ruling would carry greater weight. The Advea case shows that the court accepts conditional fines in orders of magnitude that may be compared with business volumes, which is the core of the Consumer Ombudsman’s strategy.
Consequences
For Postkodföreningen, what is at stake is a prohibition against the advertising video in question and a conditional fine at an unspecified, but potentially high, level; an adverse judgment would also create precedent for how Chapter 15, Section 1 of the Gambling Act is applied in social media.
For other gambling licence holders, a ruling would mean that short, visual and algorithmically distributed formats risk the same assessment, since case law remains thin specifically in relation to social media.
For the market, the judgment could have an impact far beyond the individual advertiser, similar to the case against a law firm concerning misleading job advertisements previously reported by Realtid.
Politically, a court ruling would fill the gap that arose when the Riksdag rejected the adjusted moderation requirement in 2022.

Zlatan and Helena Seger denied leave to appeal by Supreme Court, rent dispute settledCopy link
The final word has been spoken in the dispute involving Zlatan Ibrahimovic and Helena Seger. Today it is clear that the couple has been denied leave to appeal by the Supreme Court. In short, the dispute concerned whether the tenant must…
Analysis
In the event of such circumvention, the tenant has the same rights in relation to Ibrahimović and Seger as if the tenancy had been granted directly to him.
Under Chapter 2, Section 5 of the Private Lettings Act (2026:772), rent tribunals hear disputes concerning rent, and Section 23 of the Rent Negotiation Act (1978:304) governs repayment obligations.
Core issue
The legal position is now final: the Ibrahimović/Seger couple lost the case at all instances, and the tenant may remain in the apartment with the same rights as a tenant holding a first-hand lease. The central legal issue was whether an arrangement involving a letting company as an intermediary circumvented the tenant’s security of tenure and right to a reasonable rent. The decisive rules are those in Chapter 12 of the Swedish Land Code concerning security of tenure and reasonable rent, which, in the courts’ assessment, may not be circumvented through nominee arrangements.
Legal assessment
Stockholm District Court found that the legal relationship “may be presumed to have been used to circumvent provisions of tenancy legislation that are intended for the benefit of N.N.”
The Court of Appeal found a community of interest between the couple and the letting company in relation to the tenant.
The tenant relied on Supreme Court precedent and argued that he had paid excessive rent under the nominee arrangement.
Consequences
The tenant may remain in the apartment with the same rights as a first-hand tenant, including protection under Chapter 12 of the Swedish Land Code.
The couple cannot terminate the agreement on the basis that the intermediary existed; the termination is ineffective insofar as it was based on that arrangement.
For property owners who let through companies, the message is that courts will pierce arrangements involving a community of interest; similar structures risk the same outcome.

Lobby register to be introduced next yearCopy link
The issue of a lobby register has been debated for a very long time. Tobaksfakta and others working in tobacco prevention have long called for transparency to make any influence tobacco lobbyists may have on policy clear. Parliament has…
Analysis
Core issue
A limited transparency register awaits Swedish actors lobbying the Riksdag and the Government. Act (2026:1459) on transparency in communications intended to influence political decisions enters into force on 1 July 2027. The central legal issue is who is subject to the notification and reporting obligations, and in respect of which contacts. This is determined by the definition of influence communication in Section 2 of the Act and the exemptions in Section 5. Under Section 2, this means contact with a political decision-maker or that person’s staff for the purpose of influencing the preparation or determination of a matter before the Riksdag or the Government, in order to promote a particular interest or outcome. Providing advice or support, on assignment, to someone who has or intends to have such contact is also covered. Under Section 3, the covered persons include members of the Riksdag, government ministers and specified staff, including political advisers, state secretaries and inquiry secretaries.
Legal assessment
The registration obligation applies to legal persons and sole traders that engage in influence communication under Section 4. Exemptions under Section 5 apply, inter alia, to:
sole traders whose principal activity is not public affairs and communications;
public authorities acting within the scope of their remit;
other states, the EU and intergovernmental organisations within diplomatic relations;
political parties holding seats or receiving state or party support under Act (1972:625), and their affiliated organisations.
The notification obligation also does not apply to customary contacts in administrative matters or participation in government working groups and inquiries, where such participation is documented under the second paragraph of Section 5. Under Section 8, the registered party must submit reports to the Legal, Financial and Administrative Services Agency at three fixed points each year: by 1 June (January-April), 1 October (May-August) and 1 February (September-December). Under Section 9, the report must include the subject matters, the names of decision-makers or information on the ministry, unit or committee, and the manner and approximate extent of the contacts. Clients must be identified where the communication was carried out on assignment, and inactive periods must also be reported under Section 10. The Legal, Financial and Administrative Services Agency is both the registration body and the supervisory authority. The material contains no case law on the Act, which has not yet entered into force.
Consequences
Tobacco lobbyists and other interest organisations targeting the Riksdag and the Government must apply for registration when the Act enters into force.
Companies and trade associations need to map which employees’ contacts fall within Sections 2-3, since the communication is attributed to the legal person when carried out in the service of the company.
Contacts with no link to a specific matter, such as attempts to have issues included in party negotiations of the Tidö Agreement type, are not covered; this was at the core of the Green Party’s criticism of the limited register.
A person who merely provides advice or support to another is not required under the Act to disclose information on decision-makers and contacts, which may limit the register’s practical transparency value for organisations such as Tobaksfakta.
Next step: the material does not state when the Legal, Financial and Administrative Services Agency will open registration or provide access to the register.

Liam Nebel remanded in custody again after new allegationsCopy link
Analysis
Detention may nevertheless be ordered only if the reasons outweigh the intrusion entailed by the measure, pursuant to Chapter 24, Section 1, third paragraph.
The maximum period of detention under Chapter 24, Section 4 a of the Code of Judicial Procedure is nine consecutive months before charges must be brought.
Core issue
Liam Nebel is now subject to an extended deprivation of liberty: the same remand framework, but with an expanded basis of alleged offences and a heavier evidentiary position. The fact that Västerås District Court has remanded him in custody for two additional counts of attempted murder means that the grounds for detention have been reassessed in relation to new suspicions. The precise legal issue was whether the conditions for remand under Chapter 24, Section 1 of the Swedish Code of Judicial Procedure (1942:740) — probable cause, grounds for detention, and proportionality — are also satisfied in respect of the new acts. The suspicion concerns attempted murder, which clearly satisfies the offence-qualification requirement in Chapter 24, Section 1, second paragraph, point 2: an attempt to commit an offence with a penal value exceeding four years’ imprisonment. The fact that the accused is already detained for murder is immaterial to the new assessment; each suspicion must independently sustain the detention.
Legal assessment
The remand procedure follows a fixed pattern under the cited provisions:
The prosecutor submits a remand application specifying the offence, the ground relied upon, and the time of deprivation of liberty, pursuant to Chapter 24, Section 11 of the Code of Judicial Procedure.
A hearing must be held as soon as possible and never later than four days after the decision has been executed; Chapter 24, Sections 14-16 govern the form of the hearing, and the suspect’s absence does not prevent determination of the matter.
The decision must identify the offence to which the suspicion relates and the ground for detention, pursuant to Chapter 24, Section 5; the detained person is entitled to be informed of the circumstances underlying the decision under Chapter 24, Section 9 a.
The grounds for detention may consist of a risk that the suspect will abscond from prosecution, impede the investigation by tampering with evidence, or continue criminal activity, under Chapter 24, Section 1, first paragraph.
The court must at the same time set a deadline for prosecution under Chapter 24, Section 18; within that period, charges must be brought or an extension requested, failing which the court must revoke the decision under Chapter 24, Section 20.
In the case of an 18-year-old, Chapter 24, Section 4 applies in relation to serious harm to health or age; detention then requires that adequate supervision cannot be arranged. Special restrictions for persons under the age of eighteen are contained in specific provisions, and the duty to provide information is implemented under Section 9 a of the Preliminary Investigations Ordinance (1947:948) concerning the conditions for deprivation of liberty under Chapter 24 of the Code of Judicial Procedure and Section 23 of the Act (1964:167) with Special Provisions on Young Offenders.
Enforcement of a remand decision is governed by the Detention Act (2010:611), Chapter 1, Section 1 of which provides that the Act applies to placement, contacts, control measures, and healthcare for detained persons. The material discloses no case law in the matter; no precedent can therefore be invoked here.
Consequences
For Liam Nebel, the renewed remand means that the two new suspicions of attempted murder form part of the same investigation and likely the same future indictment. The number of injured parties has increased from 12 to 21, which affects the scope of compensation claims and the length of the main hearing. For the prosecutor, the evidentiary burden increases: each new act requires probable cause if the detention is to withstand scrutiny.
