Tenants pay the price when rent negotiations stallCopy link
Nobody benefits when rent negotiations drag on. Tenants should be able to know what rent applies, property owners must be able to plan their business, and the housing market needs stable rules of the game. Yet late decisions and…
Analysis
Correction. The article asserts that "today's rules make it possible to drag out rent negotiations without any real consequences". This is incomplete: the source material shows that existing law already contains consequences – partly that claims not pursued in time in the arbitration route under the Rent Negotiation Act entail loss of the right of action, and partly that the landlord, under Section 58 b of the Land Code, is subject to an obligation to pay compensation to the tenant if, during mediation, the landlord demands a higher rent so that the extension does not materialise. A more accurate formulation would be that the consequences today are asymmetric or insufficient to create incentives for prompt decisions, rather than that they "do not" exist; the article also fails to mention that the tenant has a statutory right to compensation under Section 58 b precisely when the landlord stalls the negotiations by raising its demands.
After a negotiation under the negotiation procedure that has concluded without agreement, both the landlord and the tenant have the right to apply to the rent tribunal for an adjustment of the rent terms.
A decision of the rent tribunal under the Act on Rent Negotiations is appealable to the Svea Court of Appeal within three weeks pursuant to Section 31.
Core issue
When the rent negotiations in Värmland have reached an impasse, the parties do not await a court but rather the rent tribunal or arbitration proceedings. The same right applies if the negotiation could not be held due to an impediment not attributable to the applying party. The debate article points out that the regulatory framework lacks mandatory time limits, which means that a decision may be issued retroactively far into the year. The concrete legal question is therefore when, and with what effect, a rent may be adjusted where negotiations have failed. The decisive provisions are Section 24 of the Act on Rent Negotiations, Chapter 12, Sections 55a–55f of the Land Code, and, for the rent tribunal's procedure, the Act (1973:188) concerning Tenancy Boards and Rent Tribunals.
Legal assessment
The application follows a fixed sequence with several conditions and steps:
Under the negotiation procedure, Section 5 of the Act on Rent Negotiations imposes an obligation on the landlord, on its own initiative, to negotiate rent increases; a request for negotiation is thus a precondition.
After a failed negotiation, either party may, under Section 24, bring proceedings before the rent tribunal for an adjustment of the rent terms.
Under Section 11a of the Act (1973:188), in a rent dispute the rent tribunal may not consider the landlord's claim for a higher rent unless a negotiation has taken place, unless an impediment has arisen that is not attributable to the landlord.
Arbitration is applied under Section 23c of the Act on Rent Negotiations with the support of the Act (2022:1657) on dispute resolution within the framework of certain collective rent negotiations.
Under the Act (1973:188), the tribunal may decide large bundles of disputes without a hearing once an appropriate number of representative cases has been examined, which is the practical handling of mass claims concerning rents. The article's author demands legislative amendment: that the property owner should be able, without a separate agreement, to refer a dispute to arbitrators, that the negotiation period be limited, and that proceedings be simplified with decisions based on objective economic criteria. The source material contains no case law that can be cited as to how these delimitations have been resolved in practice.
Consequences
For tenants: continued uncertainty as to the applicable rent during the year and the risk that a rent tribunal decision will have retroactive effect, which directly affects household finances.
For property owners: unclear revenue for large parts of the year while operating, maintenance and investment costs continue to run, which, according to the article, risks delaying maintenance and new construction.
For the system: according to the article, the impasse recurs across the country, which is taken as evidence that it is the Act on Rent Negotiations (1978:304) that needs to be reviewed, not individual negotiations.
The reform demands are addressed to the parliamentary parties.
The concrete next step for the Värmland parties is for one of them to apply to the rent tribunal for an adjustment of the rent terms under Section 24.

Consumer Agency sues Postkodlotteriet – wants to ban inflammatory gambling ads on InstagramCopy link
The Swedish Consumer Agency (KO) has filed a lawsuit against the Swedish Postcode Foundation with the Patent and Market Court. The case concerns a single advertisement on Instagram, but the Consumer Ombudsman's ambition is broader: to have…
Analysis
Under KOVFS 2025:2, Section 2.1, an overall assessment of the presentation, content, and design on the medium is required.
By way of comparison, in the Advea case the Patent and Market Court attached an interim penalty payment totalling SEK 3.5 million to its decision.
Core issue
Svenska Postkodföreningen faces civil prohibition proceedings before the Patent and Market Court, in which the Consumer Ombudsman seeks an injunction against a single Instagram advertisement, subject to a penalty payment. The case thus concerns neither a permit nor a licence, but whether the marketing contravenes the moderation requirement in Chapter 15, Section 1 of the Gambling Act (2018:1138). The precise legal question is whether the film featuring rain of winning cheques, the figure of SEK 101 million in gold-coloured text, and a time-limited half-price offer is moderate. In the submission, the legal position on social media is described as thin in terms of precedent, which is the Consumer Ombudsman's stated reason for bringing the action.
Legal assessment
The Consumer Ombudsman's objection concerns two circumstances that the guidelines address separately:
that the lottery is presented as socially attractive, something everyone ought to take part in — the guidelines in KOVFS 2025:2 state that marketing should not convey the impression that gambling solves social problems or is an alternative to employment or income;
that the half-price offer with a final purchase date creates urgency — the guidelines in Section 2.2.2 state that encouraging messages that may lead to an ill-considered decision should not be regarded as compatible with the moderation requirement.
According to the news report, the Gambling Act requires that the information be limited to facts about the lottery and presented as objectively as possible. The guidelines in Section 2.2.1.1 moreover prohibit design that gives the appearance of greater chances of winning, for example the impression that it is easy to win large sums. The penalty amount is, according to the Consumer Ombudsman's claim, linked to the lottery's revenues of just over SEK 3.5 billion as reported in the 2025 annual report. In autumn 2022, the Riksdag rejected the bill "A Strengthened Gambling Regulation" on the grounds that case law was in the process of being established; the court must now fill that gap.
Consequences
If the claim succeeds, the advertisement will be prohibited, and under the Consumer Ombudsman's claim the prohibition may be combined with a penalty payment of a relatively high level given the revenue base of SEK 3.5 billion.
A judgment would carry more weight than the Swedish Consumer Agency's general guidelines from 2025, which, according to the news report, are merely guidelines, and would thereby set a benchmark for gambling advertising on social media.
For licence holders on the gambling market, this means that short, visual, and algorithmically distributed formats must be tested against the overall assessment in KOVFS 2025:2, Section 2.1.
Postkodlotteriet must now respond to the Consumer Ombudsman's objections before the court.

Zlatan and Helena Seger denied leave to appeal in Supreme Court – rent dispute settledCopy link
The final word has been spoken in the dispute between Zlatan Ibrahimovic and Helena Seger. Today it became clear that the couple has been denied leave to appeal by the Supreme Court. The dispute, in brief, concerned whether the tenant…
Analysis
The tenant may thus remain in the premises with the same rights as a first-hand tenant, notwithstanding that the couple terminated the contract.
Core issue
The legal position of Ibrahimovic and Seger is now final: the Supreme Court has refused leave to appeal, and the judgment of the Court of Appeal therefore stands as final. What proved decisive was not the wording of the lease agreement, but the finding that an intermediate rental company had been used as a front (straw man). The courts found a community of interest between the property owners and the rental company vis-à-vis the tenant. The legal question was whether the legal relationships had been exploited in order to circumvent the protective provisions of tenancy legislation. Decisive are the provisions of Chapter 12 of the Land Code concerning security of tenure and reasonable rent, which operate in favour of the tenant.
Legal assessment
In a front-company arrangement, the formal contractual structure is pierced, placing the tenant on an equal footing with a direct tenant of the real counterparty.
The Stockholm District Court held that the tenant has the same rights against Ibrahimovic and Seger as if they had let the tenancy directly to him.
The Court of Appeal shared the assessment of the community of interest between the couple and the rental company.
The tenant relied on Supreme Court precedent and asserted that he had paid excess rent within a front-company arrangement benefiting the property owner.
The arguments advanced by the couple in the Court of Appeal did not alter the court's assessment. The rules protecting against such arrangements are intended to ensure that contractual terms and constructions detrimental to the tenant have no effect, in line with the principal rule in, inter alia, Section 2 of the Act (2012:978) on the Letting of One's Own Dwelling, pursuant to which disadvantageous contractual terms have no effect against the tenant. In practical terms, the judgment means that the couple cannot rely on the notice of termination they served on the tenant.
Consequences
The tenant remains in the apartment with the rights of a first-hand tenant, including security of tenure under Chapter 12 of the Land Code.
Ibrahimovic and Seger bear the costs and risks attendant upon a direct letting relationship, including requirements of reasonable rent; the tenant has moreover asserted a right to repayment of excess rent.
The couple has no further ordinary remedies, as the Supreme Court has refused leave to appeal; the judgment is accordingly enforceable.
For the market, the outcome signals that intermediary constructions in residential lettings do not shield property owners from the protective provisions of tenancy legislation.
According to the underlying material, the next step is the enforcement of the judgment against Ibrahimovic and Seger.

Analysis
Legal question
Whether a subtenant in a sham arrangement (bulvanupplägg), where the property owner leases out premises through a rental company in order to circumvent the Land Code's tenancy provisions, can invoke the same statutory protections as a direct (first-hand) tenant – and whether that question, settled by the District Court and the Court of Appeal, should be examined by the Supreme Court.
Legal basis
The underlying material contains no directly applicable statutory text, so the reasoning rests on a general legal principle that is well established in Swedish tenancy law: in a sham arrangement – where the landlord interposes a rental company in order to deprive the tenant of the protection afforded by the tenancy provisions of the Land Code (jordabalken) – the tenant is to be treated as if the tenancy agreement had been concluded directly with the real landlord. This means that such a tenant can be given notice only on the limited grounds for termination that apply to first-hand tenants, and that the tenant may refer a termination dispute to the Rent and Tenancies Tribunal (hyresnämnden) for mediation within two months of the notice, pursuant to Chapter 58 of the Land Code. It was precisely this principle that the District Court and the Court of Appeal applied when they found that Ibrahimovic and Seger had let the premises through an intermediary and had thereby sought to circumvent the tenancy legislation.
What case law says
The outcome shows that the courts applied the sham-arrangement principle consistently in this case: the District Court held that the tenant is entitled to remain in the premises with the same rights as a first-hand tenant; the Court of Appeal upheld that judgment; and the Supreme Court refused leave to appeal, with the result that the Court of Appeal's judgment stands. The Supreme Court's refusal of leave to appeal is not a substantive endorsement of the legal position; however, since the Court of Appeal's judgment is now final, it carries practical weight as a strong point of reference in similar sham-arrangement cases in the Stockholm area. The total costs of the proceedings of SEK 422,000, which the couple must pay, illustrate the financial risk of taking such a dispute to its conclusion.
Correction
The article states that the tenant has been given notice in a parallel process before the Rent and Tenancies Tribunal, which may give the impression that the Tribunal examines termination issues on its own initiative. This is incomplete: under Chapter 58 of the Land Code, it is the tenant who must refer the dispute to the Tribunal for mediation within two months of the notice, and the Tribunal thereafter mediates and determines those matters referred to it pursuant to Section 9 of Ordinance (1973:188). The article should be refined to make clear that the Tribunal's jurisdiction presupposes a timely referral, and that mediation is the first step in the procedure. [PRAKTIKINE_REIKSME]: The argument that a subtenant in a sham arrangement enjoys the protection of a first-hand tenant has, in conclusion, been reinforced by the Supreme Court allowing the Court of Appeal's judgment to stand – a point which counsel in the case himself highlights as a strength in the ongoing proceedings before the Rent and Tenancies Tribunal.
In practical terms, this means that property owners who let premises through rental companies cannot invoke the intermediary's contractual terms or shorter notice periods against the tenant, and that they risk both losing on the merits and being ordered to pay the opposing party's full legal costs. At the same time, anyone representing a tenant must be mindful of the two-month time limit running from the notice, within which the dispute must be referred to the Rent and Tenancies Tribunal – a missed deadline may, despite a strong case on the merits, defeat the protection available at the termination stage.
Lobbyist Register to Be Introduced Next YearCopy link
The question of a lobbyist register has been discussed for a long time. Tobaksfakta and others working in tobacco prevention have long called for transparency to make tobacco lobbyists' potential influence on politics visible. Now the…
Analysis
No later than 1 June for the period January–April, no later than 1 October for the period May–August, and no later than 1 February for the period September–December.
Under Section 2, contact with a political decision-maker or that person's staff, for the purpose of influencing the preparation or decision of a matter before the Riksdag or the Government, is covered.
Core issue
The Riksdag's decision means that tobacco lobbyists and other influence actors will, from 1 July 2027, be subject to a registration and reporting obligation under Act (2026:1459) on Transparency in Communications Aimed at Influencing Political Decisions. For actors such as Tobaksfakta that have called for this, the core of the news is that transparency is now becoming statutory, albeit to a limited extent. The precise legal question is which contacts must be reported and to whom. Under Section 3, covered persons include members of the Riksdag, ministers, staff serving as political secretaries, employees of the Riksdag Administration, state secretaries, political advisers, and inquiry secretaries.
Registration takes place with the Swedish Legal, Financial and Administrative Services Agency (Kammarkollegiet), which also serves as the supervisory authority.
The Act enters into force on 1 July 2027 pursuant to its transitional provisions.
Legal assessment
The reporting obligation follows from Section 8: the registered actor must submit reports to Kammarkollegiet three times per year. The content is governed by Section 9: the subjects of the influence communications and the names of the political decision-makers with whom contacts occurred, or, for staff members, the ministry, unit, or committee concerned. Communications carried out on behalf of another party must be indicated, as must the particulars of the commissioning party. A person who has merely provided advice or support to another is subject to a lighter obligation under Section 9. The exemptions are significant for the delimitation. Under the Act, the reporting obligation does not apply to ordinary contacts within the handling of official business, or to participation in government-appointed working groups and inquiries where such participation is documented. Nor are contacts with political parties holding a mandate, or contacts within the framework of international cooperation and diplomatic relations, covered. If the registered actor conducts no influence communications during a period, this must nonetheless be stated in the report pursuant to Section 10. The underlying material contains no case law; the decisive factor is therefore the structure of the statutory text, with Sections 2–3 as definitional provisions and Sections 8–10 as the reporting rules. The criticism from Annika Hirvonen of the Green Party concerned the fact that contacts without any connection to a specific matter — for example, assignments under the Tidö Agreement or the January Agreement — are not covered. Under the Act's definition in Section 2, the purpose must be to influence the preparation or decision of a matter, which excludes such political arrangements from the register.
Consequences
For tobacco lobbyists: from July 2027, an obligation arises to register and periodically report contacts with the Riksdag and the Government, with supervision by Kammarkollegiet.
For organisations such as Tobaksfakta: the register provides a tool for tracking the tobacco industry's contacts, but only for matter-related influence communications.
For members of the Riksdag and the Government Offices: contacts may be published by name or unit, which increases transparency but is limited by the exemptions.
For Annika Hirvonen and advocates of a broader register: the criticism did not prevail, and an extension to inter-party negotiations would require future legislative amendment.
The next step in the process is for Kammarkollegiet to prepare registration and supervision ahead of the entry into force on 1 July 2027.
