Tenants Pay the Price When Rent Negotiations StallCopy link
No one benefits when rent negotiations drag on. Tenants should know what rent applies, property owners need to plan their operations, and the housing market needs stable rules. Yet delayed notices and retroactive rent increases have become…
Analysis
Correction. The article states that “the current framework makes it possible to drag out rent negotiations without any real consequences”. This is inconsistent with the material: the Rent Negotiation Act contains an express consequence rule under which the negotiation arrangement is deemed extended for one year if notice of termination is not given in due time, as well as an invalidity sanction in Section 23, which renders rent increases invalid where negotiations have not been carried out and entails a repayment obligation together with interest under Section 6 of the Interest Act. More precisely, the article should state that the framework does have sanctions, but that they do not create sufficient incentives for the parties to reach a decision in time; in other words, the problem is insufficient, not absent, legal consequences.
Section 23 provides that an agreement entered into by the landlord with an individual tenant is invalid if negotiations under the negotiation procedure have not taken place, or if the agreement concerns an increase beyond what is permitted by the negotiation agreement.
A meeting must be held within three weeks from the date on which the other party received the request, unless the parties agree otherwise in writing.
Core issue
Tenants in Värmland face a legal situation in which this year’s rent has not yet been determined, because the parties have not reached a negotiation agreement under the Rent Negotiation Act (1978:304). While the negotiations are ongoing, no new rent may be applied under the negotiation procedure, and when a decision is eventually announced it may have retroactive effect. For the property owner, the deadlock means that rental income for 2026 remains uncertain, while tenants bear the risk of retroactively adjusted increases. The precise legal issue is how a rent dispute is to be resolved when collective rent negotiations fail, and what avenues for dispute resolution the law provides. The decisive provisions are found in the Rent Negotiation Act (1978:304): Section 5 regulates the obligation to negotiate rent increases, Section 15 governs how negotiations are initiated, and Section 23 sets out the consequences if the landlord nevertheless applies a rent without completed negotiations. From the tribunal perspective, Section 11a of the Act (1973:188) on Regional Tenancy Tribunals and Rent Tribunals provides that a Rent Tribunal may not examine a claim for higher rent if the negotiations required under the negotiation procedure have not taken place.
Legal assessment
Under Section 5 of the Rent Negotiation Act, the negotiation procedure imposes an obligation on the landlord to negotiate rent increases on its own initiative, unless the increase concerns an optional add-on and does not exceed a price recommended by the parties to the negotiation procedure.
Section 11a of the Act (1973:188) prevents the Rent Tribunal from examining the landlord’s claim for higher rent if negotiations have not taken place, but if the landlord has initiated negotiations and encountered an obstacle not attributable to the landlord, the claim may nevertheless be admitted.
Where negotiations reach deadlock, the practical route used is arbitration; the opinion piece seeks to make this a statutory right for landlords to refer the dispute to an arbitrator without special agreements.
Under the material relating to Section 18 of the Land Code (the order on repayment), an order for repayment of rent may not cover a period further back than two years before the application date; in the event of a retroactive increase or reduction, the fifth to eighth paragraphs of Section 55e apply.
The material contains no case law, so no precedents can be presented.
Consequences
Scenario for tenants: continued rent uncertainty during 2026, followed by a retroactive adjustment once an agreement, arbitral award, or Rent Tribunal decision is issued; in the case of an invalid agreement without negotiations, the landlord may be required to repay rent received, with interest.
For the property owner: uncertain income for much of the year, while operating and maintenance costs continue to accrue; rent applied incorrectly without negotiations gives rise to a repayment obligation under Section 23.
Politically: the opinion piece calls for reforms to the Rent Negotiation Act, namely a statutory right to arbitration, a limited negotiation period, and simplified proceedings before the Rent Tribunal, which would require a decision by the Riksdag.
Next step in the individual matter: for the parties to initiate negotiations again by written request under Section 15, or for the dispute to be referred to an arbitrator.

Consumer Ombudsman sues Postcode Lottery, seeks ban on aggressive Instagram adsCopy link
Sweden’s Consumer Ombudsman has filed a lawsuit against Svenska Postkodföreningen in the Patent and Market Court over an Instagram ad showing prize checks raining down on a residential neighborhood, aiming to clarify how the Gambling Act’s…
Analysis
Under Chapter 15, Section 4 of the Gambling Act, marketing that contravenes Section 1 is deemed unfair towards consumers for the purposes of Sections 5, 23 and 26 of the Marketing Practices Act (2008:486).
As a reference point for the level of the conditional fine, the Advea case is highlighted, where the Patent and Market Court attached an interim conditional fine totalling SEK 3.5 million to its decision against a credit intermediary.
Core issue
Svenska Postkodföreningen faces a procedural hearing before the Patent and Market Court, where the Consumer Ombudsman seeks an injunction prohibiting a single Instagram advertising video, coupled with a conditional fine. At stake is a fine whose amount may be calibrated against the company’s revenues. The Consumer Ombudsman has cited Postkodlotteriet’s lottery revenues for 2025, just over SEK 3.5 billion, as the basis for a comparatively high fine. The precise legal issue is whether the video, featuring falling prize cheques, SEK 101 million in gold-coloured text, and a time-limited half-price offer, satisfies the moderation requirement in Chapter 15, Section 1 of the Gambling Act (2018:1138). The Consumer Ombudsman’s objection is twofold: the video portrays the lottery as socially attractive and creates an impression of urgency to buy a ticket.
Legal assessment
The assessment is made as an overall assessment under KOVFS 2025:2 (section 2.1), covering the presentation itself, the content, and the design in the chosen medium.
Section 2.2.1 of the guidance states that gambling marketing must not be intrusive or designed to attract particular attention; section 2.2.2 addresses exhortatory messages that may encourage an ill-considered decision to gamble.
Section 2.2.1.1 prohibits design that gives the impression that the chances of winning are greater than they are; the guidance further requires factual and balanced marketing that does not present gambling as risk-free.
Time-limited offers with a final purchase date, presented visually and distributed algorithmically on social media, fall squarely within the guidance’s treatment of exhortatory and intrusive design.
The Swedish Consumer Agency’s general guidance (KOVFS 2025:2) is not binding, but under Section 26 of the Marketing Practices Act the court must take it into account when assessing unfairness. The material contains no precedent on moderation in social media; the case law is described as thin. In autumn 2022, the Riksdag rejected the Government’s proposal for an adjusted moderation requirement in the bill *A Strengthened Gambling Regulation*, on the grounds that case law was in the process of being established; the court must therefore fill the gap.
Consequences
For Postkodlotteriet: a prohibition on the video in question, in practice on the form of marketing it represents, coupled with a conditional fine whose level the court may weigh against billion-krona revenues.
For the gambling market: a ruling would carry greater weight than the Swedish Consumer Agency’s general guidance and create a precedent for how Chapter 15, Section 1 of the Gambling Act is applied to short, visual formats on social media.
For the Consumer Ombudsman: developed case law would give the authority a tool against other licence holders, similar to how marketing cases can have effects far beyond the individual advertiser.
Postkodlotteriet must now respond to the Consumer Ombudsman’s objections before the court.

Zlatan and Helena Seger denied leave to appeal in Supreme Court as rental dispute is settledCopy link
The dispute between Zlatan Ibrahimovic and Helena Seger and their tenant has now reached its end, with the Supreme Court denying the couple leave to appeal. The case centered on whether the tenant must move out after his contract was…
Analysis
In such circumstances, the tenant has the same rights in relation to Zlatan and Helena Seger as if they had granted the tenancy directly to him.
Core issue
The legal position for Zlatan Ibrahimović and Helena Seger is now final: the Supreme Court has refused leave to appeal, and the Court of Appeal’s judgment stands as the legal outcome in the tenancy dispute. The decisive legal issue was whether the tenant, whose contract had been terminated by the property owners, nevertheless has the same status as a direct tenant with security of tenure. The provisions of Chapter 12 of the Swedish Land Code on security of tenure and reasonable rent determine the issue, and the courts have applied the principle that a legal arrangement may not be used to circumvent such protective provisions in favour of the tenant.
Legal assessment
The Stockholm District Court found that the tenant has the same rights in relation to Ibrahimović and Seger as if they had granted the tenancy directly to him. The District Court wrote that it may be assumed that the legal arrangement was used to circumvent provisions of tenancy legislation that are intended to benefit the tenant. The Court of Appeal adopted the same approach and found a community of interest between the couple and the rental company in relation to the tenant. For his part, the tenant had argued, relying on Supreme Court precedent, that he had paid excessive rent under a nominee arrangement that benefited the property owner. The structure means that the termination by Ibrahimović and Seger does not have its intended effect: the tenant may remain in the apartment with the same rights as a direct tenant.
Consequences
Ibrahimović and Seger must now accept the adverse appellate assessment as the final outcome; the tenant remains in the apartment with security of tenure.
For property owners who rent out through intermediaries, the judgment signals that nominee-like arrangements do not deprive the tenant of the protections under Chapter 12 of the Swedish Land Code.
The tenant may in future assert reasonable rent and security of tenure directly against the couple.

Analysis
Correction. The article gives the incomplete impression that letting through an intermediary is always an impermissible circumvention. The correct position is that the nominee analysis is triggered only where the letting lacks permission for a block lease or a block lease agreement; such a letting is, under the Land Code’s exception, fully lawful and does not give the subtenant the status of a direct tenant. The article also suggests that the losing landlord must automatically pay the other side’s litigation costs. Under the cost rule in the Private Letting Act, in certain tenancy disputes, specifically disputes concerning rent under Chapter 2, Section 5, each party must instead bear its own costs in the Court of Appeal. The outcome on costs is therefore not self-evident in all tenancy disputes, but depends on which dispute rule applies. It should also be noted that the article presents the outcome as a “Supreme Court judgment”, whereas formally it is a decision refusing leave to appeal; the Court of Appeal’s judgment is thereby upheld without substantive examination by the Supreme Court.
Under Section 2 of the Private Lettings Act (2026:772), an agreement that applies indefinitely may be terminated no earlier than at the month-end falling three months after notice is given.
The couple must pay SEK 422,000 in litigation costs for the proceedings before the District Court and the Court of Appeal.
Core issue
Zlatan Ibrahimovic and Helena Seger now face a final defeat in the tenancy dispute, as the Supreme Court has refused leave to appeal and the Court of Appeal’s judgment has therefore become final. The legal position facing the couple is liability to pay the tenant’s litigation costs totaling SEK 422,000, and the tenant also has the right to remain in the Östermalm apartment with the same rights as a tenant under a direct lease. The legal crux is the issue of a nominee arrangement: the District Court found that the couple had let the apartments through a rental company acting as intermediary in order to circumvent tenancy law, meaning that the subtenant must be treated as a tenant under a direct lease. This is based on the much-discussed Supreme Court nominee judgment, which the tenant invoked in the statement of claim. The regulation of residential tenancies between private individuals is found in the Private Lettings Act (2026:772) and in the Land Code (1970:994), which govern the tenant’s protection against termination and forfeiture of the tenancy.
Legal assessment
Under the confirmed judgment, the parties are obliged to respect the tenant’s status as a direct tenant, which means that termination of the tenancy agreement can no longer be based on the grounds applicable to subletting. The tenant, in turn, is entitled to a rent reduction for defects under Chapter 4, Section 4, and to damages under Chapter 4, Section 6, if the landlord does not show that the defect was not due to the landlord’s negligence. For the couple, the judgment also means that, under Section 4 of the Private Lettings Act, they cannot claim damages from the tenant, since it is the landlord who lost the case. The material contains no specific case law with case numbers apart from the referenced nominee judgment, but its effect is that a tenant in a nominee arrangement receives the same protection as if the agreement had been entered into directly with the property owner.
Consequences
The tenant may remain in the apartment with the same rights as a tenant under a direct lease.
The parallel proceedings before the Rent Tribunal, in which the tenant has been given notice, have not yet been decided; according to counsel Roland Sjölin, the tenant’s prospects of success there have improved as a result of the Supreme Court’s decision.
For other property owners who let through rental companies, the case shows that nominee arrangements may result in tenants being treated as direct tenants, with the consequence that the right to terminate agreements is lost.
The next step in the proceedings is the Rent Tribunal’s decision on the termination issue.

Lobby register to be introduced next yearCopy link
The issue of a lobby register has been debated for a long time. Tobaksfakta and others working in tobacco prevention have long called for transparency to make any influence by tobacco lobbyists on policy clear. Parliament has now approved…
Analysis
The report must be submitted to Kammarkollegiet no later than 1 June for the period January-April, no later than 1 October for the period May-August, and no later than 1 February for the period September-December.
If the registered person has not carried out any influence communication during the period covered by the report, this must be stated in the report.
Core issue
Companies, trade associations, and other actors seeking to influence decisions of the Riksdag or the Government will be subject to registration and reporting obligations from 1 July 2027, when Act (2026:1459) on Transparency in Communications Intended to Influence Political Decisions enters into force. The decisive legal question is which contacts constitute influence communication and therefore require registration with Kammarkollegiet, which both maintains the register and acts as the supervisory authority. Under Section 2 of the Act, influence communication means that a natural or legal person contacts a political decision-maker or that person’s staff in order to influence the preparation or determination of a matter before the Riksdag or the Government, with a view to promoting a particular interest or outcome. Providing advice or support, on assignment, to someone who has such contact is also covered. The scope is therefore matter-specific: contacts concerning issues agreed by political parties before the formal process, such as under the Tidö Agreement or the January Agreement, are not covered.
Legal assessment
Under Section 3, political decision-makers are members of the Riksdag and government ministers; staff include, among others, political secretaries, employees of the Riksdag Administration, state secretaries, political advisers, and inquiry participants appointed by the Government.
The reporting obligation under Section 4 does not apply to customary contacts in administrative matters or participation in government-appointed working groups and inquiries where the participation is documented for the public.
Under Section 9, the report must include the subject matters and the names of the decision-makers, or the ministries, units, or committees, to which the contacts related, as well as the method of contact and its approximate extent.
Where the influence communication has taken place on assignment, the client must be identified; a person who has only provided advice or support is exempt from providing those details under the same section.
Section 10 requires the registered person to state the reporting period even if no influence communication has been carried out; a nil report is therefore mandatory.
The register supplements the existing system under Act (1996:810) on the Registration of Members of the Riksdag’s Commitments and Financial Interests, under which members must report commitments and financial interests to the Riksdag Administration within four weeks.
Consequences
Tobacco lobbyists and other interest organisations must organise documentation of every contact with decision-makers in matter-specific cases; otherwise, reporting to Kammarkollegiet will be incomplete.
Consultants and agencies lobbying on assignment risk both their own details and the client’s details becoming public in the register.
The Green Party’s criticism in favour of comprehensive registration, including contacts concerning party programmes and preliminary agreements, was not accepted; legal persons may therefore lawfully exert influence outside the scope of the register.
Compared with the financial register, the contact register provides a partly different safeguard: members’ interests are still disclosed independently of Act (2026:1459).
The exemptions in Section 4 for documented participation in inquiries mean that influence exercised through the Government’s inquiry system can, in practice, be followed through public documentation instead.

Improve animal welfare and phase out fast-growing chickensCopy link
Katarina Erlingson argues that Sweden can no longer rely on its past reputation as a leader in animal welfare, pointing to recent TV4 Kalla fakta footage from chicken farms showing fast-growing Ross 208 chickens struggling to stand, walk…
Analysis
Under Section 8 of SJVFS 2021:47, broiler lines with average growth of no more than 45 grams per day are deemed slow-growing until 1 January 2032.
Permit matters under Chapter 6, Section 4 are examined by the county administrative board under the Animal Welfare Ordinance (2019:66).
Core issue
The future of turbo chicken will not be determined by a new law, but by whether policymakers choose to amend the rules currently in force: today, Ross 208 is fully lawful to rear in Sweden. The issue is that fast-growing breeds, which reach slaughter weight in 35 days, may still be used in commercial production despite the revelations by Kalla fakta. The legal position is instead governed by the Animal Welfare Act (2018:1192) and the Animal Welfare Ordinance (2019:66), supplemented by the Swedish Board of Agriculture’s regulations. A legislative amendment or ban would require new legislation; no such decision appears in the materials.
Legal assessment
The current regulatory framework sets limits on handling, not on breed selection. Its application is as follows:
SJVFS 2008:69 imposes animal-welfare requirements on slaughterhouses: each slaughterhouse must have a plan that maintains good animal welfare from arrival through stunning and killing.
SJVFS 2024:30 regulates hatcheries, requiring hygiene rules prepared in consultation with a veterinarian, a visitor log, and one-way circulation of hatching eggs and equipment.
Under SJVFS 2000:172, the introduction of poultry requires day-old chicks to originate from a flock that has been isolated for 14 days and tested free from salmonella.
The direct payment system under SJVFS 2007:22 links support to compliance with animal-welfare rules, including Sections 3, 6 and 9-11 of the Animal Welfare Act. The definition of slow-growing already exists in the regulatory framework, but only for organic production. Ross 208, which is slaughtered at 35 days, is substantially above that rate and therefore falls outside the organic definition. The materials contain no case law, and no authority in the source material has assessed whether the breed is incompatible with the general requirements of the Animal Welfare Act.
Consequences
Without legislative change, the initiative lies with the market participants themselves. Norway’s industry has shown that phase-out can occur voluntarily and on a large scale, while Sweden has so far made no corresponding commitment. Realistic scenarios include:
Political legislation: several parties are calling for a ban; such a ban would need to be introduced in the Animal Welfare Act (2018:1192) or through regulations issued by the Swedish Board of Agriculture.
Market-driven transition: retailers and procurers can require slow-growing breeds, as the opinion piece proposes by analogy with cage eggs.
Import risk: according to the Sweden Democrats’ representative, stricter Swedish rules could lead to more imports and reduced Swedish production.
Competitive disadvantage: SLU researcher Jenny Yngvesson warns that retailers may choose Danish or Norwegian chicken if Sweden does not follow suit, which would weaken the brand. In practical terms, this affects chicken producers, who in the event of a regulatory change would need to switch breeds and adapt housing conditions, as well as the Swedish Board of Agriculture and county administrative boards as supervisory authorities. Consumers are affected through price; Coop Norway hopes that large-scale phase-out will limit price increases. Organic producers are already subject to the 45-gram rule in SJVFS 2021:47 and would therefore not need to transition to the same extent.
