Tenants pay the price when rent negotiations stallCopy link
No one benefits when rent negotiations drag on. Tenants need to know what rent applies, property owners must be able to plan their operations, and the housing market needs stable rules. Yet late decisions and retroactive rent increases…
Analysis
A negotiation meeting must be held within three weeks from the date on which the opposing party received the request.
The landlord is then obliged to repay the excess amount received together with interest under Section 6 of the Interest Act (1975:635) from the date of receipt.
Core issue
When the negotiations in Värmland reach an impasse, the parties are not left without legal recourse, but are instead subject to a compulsory procedure: arbitration under the Rent Negotiation Act (1978:304), in which an independent arbitrator determines the rent if the parties fail to reach agreement. The legal position facing tenants is, first, continued uncertainty as to the applicable rent during the negotiation period and, second, the risk that the outcome will entail a retroactive increase. The essence of the news item is that the opinion piece seeks to change the regulatory framework itself, not that any dispute has already been adjudicated. The precise legal issue is when and how a rent dispute may be referred to an arbitrator, and which time limits govern the negotiation. The decisive provisions are found in the Rent Negotiation Act (1978:304) and in the Act (1973:188) on Regional Tenancy Tribunals and Rent Tribunals. Under Section 5 of the Rent Negotiation Act, the negotiation order entails an obligation to negotiate on rent increases, unless the increase concerns an optional add-on and does not exceed a price recommended by the parties to the negotiation order.
Legal assessment
The negotiation order is established by agreement between the parties or by a decision of the Rent Tribunal under Section 1 of the Rent Negotiation Act; the Act applies to persons who regularly let more than two residential apartments.
Under Section 11 a of the Act (1973:188) on Regional Tenancy Tribunals and Rent Tribunals, the Rent Tribunal may not examine a landlord’s claim for higher rent unless negotiations under the negotiation order have taken place regarding the disputed issue; an exception applies if negotiations were requested but were prevented by an impediment not attributable to the landlord.
The material contains no case law, and therefore no judicial decisions can be relied upon.
The opinion piece proposes that landlords should have a statutory right to refer disputes to an arbitrator without special agreements, that the negotiation period should be limited, and that proceedings before the Rent Tribunal should be simplified, with decisions based on objective economic criteria; these are proposed amendments, not current law.
Consequences
For tenants: continued uncertainty as to the applicable rent during the negotiation period and the risk of a retroactive increase once the decision is issued; in the event of a retroactive increase or reduction, the provisions of Section 55 e apply pursuant to Chapter 12, Section 18 a of the Land Code, and an order for repayment of rent may not cover a period more than two years before the date of the application.
For property owners: unclear revenues for large parts of the year despite rising operating and investment costs, which, according to the opinion piece, makes it more difficult to plan maintenance and new housing.
Direct agreements with tenants without completed negotiations are invalid and give rise to a repayment obligation with interest, closing off that avenue for the landlord.
For the parliamentary parties: the opinion piece is a policy appeal to reform the Rent Negotiation Act (1978:304); no legislative amendment has been adopted in the material.
The next step in the individual case in Värmland is, if the parties do not reach agreement, for the matter to be referred to an arbitrator under the procedure described in the opinion piece.

Consumer Ombudsman sues Postcode Lottery, seeks ban on aggressive Instagram adsCopy link
Sweden’s Consumer Ombudsman has filed a lawsuit against the Swedish Postcode Association over an Instagram ad showing prize checks raining down on a residential neighborhood, aiming to clarify how gambling law requirements for moderate…
Analysis
Core issue
Postkodlotteriet now faces a full hearing before the Patent and Market Court, where the issue is whether a single Instagram advertising video breached the Gambling Act’s requirement of moderate marketing. If the Consumer Ombudsman prevails, Svenska Postkodföreningen will be subject to a prohibition backed by a conditional fine, and the court will for the first time define the moderation requirement for gambling advertising on social media. The central legal issue is whether the video, which shows prize cheques raining down, SEK 101 million in gold-coloured text, and a time-limited half-price offer, is moderate under Chapter 15, Section 1 of the Gambling Act (2018:1138). That provision requires moderation to be observed in the marketing of gambling to consumers and prohibits marketing from being specifically directed at persons under the age of 18. Under Chapter 15, Section 4 of the Gambling Act, marketing that contravenes Section 1 is to be deemed unfair to consumers for the purposes of Sections 5, 23 and 26 of the Marketing Practices Act (2008:486). It is this link that enables the Consumer Ombudsman to seek a prohibition subject to a conditional fine in court.
Legal assessment
The Consumer Ombudsman’s assessment is based on an overall evaluation: the lottery is presented as socially attractive, and the half-price offer with a final purchase date creates a sense of urgency.
According to the Consumer Ombudsman, the Gambling Act requires information to be limited to factual information about the lottery and presented as objectively as possible; the prize amount in gold-coloured text and the time pressure are therefore considered problematic.
The Consumer Ombudsman seeks a conditional fine and, as to the amount, refers to Postkodlotteriet’s 2025 annual report, which shows lottery revenues of just over SEK 3.5 billion.
The precedential value in the material is limited: in the Consumer Ombudsman’s case against the credit intermediary Adveea, the Patent and Market Court attached an interim conditional fine totalling SEK 3.5 million to its decision, showing that the court accepts substantial fines in Consumer Ombudsman cases.
The Swedish Consumer Agency’s 2025 general guidelines on the marketing of gambling are not binding; a court ruling would carry greater weight than the guidelines.
In autumn 2022, the Riksdag rejected the bill’s proposal for an adjusted moderation requirement, on the ground that case law was in the process of being established.
Consequences
Postkodlotteriet must respond to the Consumer Ombudsman’s objections before the court; if the moderation requirement is found to have been breached, a prohibition backed by a conditional fine may follow, with the amount potentially scaled by reference to its billion-krona revenues.
A ruling would have an impact far beyond the individual advertiser: all licensees marketing gambling on social media would receive guidance on what moderation requires in short, visual and algorithmically distributed formats.
For the Consumer Ombudsman, the value lies in creating case law that the authority can rely on in future matters, since court rulings carry more weight than the Swedish Consumer Agency’s general guidelines.
The next step in the proceedings is for Postkodlotteriet to submit its statement of defence to the Patent and Market Court.

Zlatan and Helena Seger denied leave to appeal in Supreme Court - rental dispute settledCopy link
The final word has been spoken in the dispute involving Zlatan Ibrahimovic and Helena Seger. It is now clear that the couple has been denied leave to appeal to the Supreme Court. In short, the dispute concerned whether the tenant must move…
Analysis
In such a nominee-like arrangement, the tenant has the same rights against Ibrahimovic and Seger as if they had granted the tenancy directly to him.
The Supreme Court’s decision not to grant leave to appeal brings the proceedings to an end, and the Court of Appeal’s judgment becomes final and binding.
Core issue
The legal position is now final: the tenant may remain in occupation with the same rights as a direct tenant, because the Supreme Court refused Ibrahimovic and Seger leave to appeal and the Court of Appeal’s judgment therefore stands. The decisive factor was not the wording of the lease agreement, but that the courts considered that an intervening letting company had been used as a nominee to circumvent statutory provisions protecting the tenant for the benefit of the property owners. The precise legal issue was whether the tenant, whose contract had been terminated by Ibrahimovic and Seger through the letting company, could invoke security of tenure and reasonable rent directly against the property owners. This is governed by Chapter 12 of the Swedish Land Code on security of tenure and reasonable rent, applied through the District Court’s and Court of Appeal’s assessment that the legal relationship had been exploited to circumvent provisions intended for the tenant’s benefit.
Legal assessment
The District Court found that it may be assumed that the legal relationship had been used to circumvent provisions of tenancy legislation for the benefit of the tenant.
The Court of Appeal further found a community of interest between the couple and the letting company in relation to the tenant.
The couple’s objections before the Court of Appeal did not alter the assessment, and the tenant relied on case law concerning excessive rent paid under an arrangement benefiting the property owner.
The material contains no specific case with a case number; however, the tenant relied on general Supreme Court case law in the area.
The pattern corresponds to the type of relationships targeted by the Act (1985:277) on Certain Nominee Relationships, under which disputes concerning ownership are heard by the District Court in which the nominee is to answer the claim (Section 8).
Consequences
Ibrahimovic and Seger must accept that the tenant remains in occupation with the rights of a direct tenant: security of tenure and reasonable rent under Chapter 12 of the Swedish Land Code.
The letting company’s intermediary role has, in practice, been looked through; future terminations must be handled directly against the tenant in accordance with the protective rules of tenancy legislation.
For the tenant, the judgment entails a continuing right to remain in occupation on terms applicable to a direct grant.
For the market, the outcome signals that nominee arrangements involving a community of interest between property owners and landlords may be disregarded by the courts.

Supreme Court Rejects Zlatan’s Appeal, Tenant Can Keep Östermalm ApartmentCopy link
Sweden’s Supreme Court has refused to hear Zlatan Ibrahimovic’s appeal in a dispute with a tenant at an Östermalm rental property he bought in 2022, meaning the Court of Appeal’s ruling stands and the tenant may keep the apartment.
Analysis
Correction. The article states that the couple “must also pay the tenant’s legal costs in the District Court and the Court of Appeal, totalling SEK 422,000” in a way that could be read as suggesting that a nominee arrangement in itself gives rise to liability for the landlord’s costs. That is not correct as a general rule: in tenancy disputes, each party in principle bears its own legal costs, and under Chapter 2, Section 5 of the Private Lettings Act, each party in a dispute concerning rent under that provision must specifically bear its own costs in the Court of Appeal. The costs consequence in this case should instead be understood as following from the couple’s complete loss on the substantive issue tried, not as an independent legal consequence of a nominee arrangement. A more precise formulation would be that, after deciding the merits, the courts ordered the losing party to pay costs under the general rules on litigation costs.
The tenant is entitled to remain in the property with the same rights as a tenant under a direct lease, and the couple must pay SEK 422,000 in litigation costs for the District Court and the Court of Appeal.
Core issue
For Ibrahimovic and Seger, the Court of Appeal’s judgment is now final, as the Supreme Court has refused leave to appeal. The precise legal issue was whether the arrangement through a rental company, a so-called nominee arrangement, means that the subtenant receives the same protection as a tenant under a direct lease. The issue is determined under the tenancy provisions of the Land Code, which, according to the District Court, were circumvented through the intermediary. The next legal development concerns the parallel proceedings before the Rent Tribunal, where the tenant has been given notice and the matter has not yet been decided.
Legal assessment
The District Court found that the couple had rented out the property through an intermediary, a nominee arrangement, and had thereby attempted to circumvent tenancy law; the Court of Appeal upheld that assessment.
The tenant successfully relied on a widely discussed Supreme Court judgment concerning nominee arrangements, which, according to the statement of claim, gives him rights equivalent to those of a tenant under a direct lease.
The Supreme Court has reviewed the material and found no grounds to grant leave to appeal; accordingly, the substantive issue will not be examined again.
Ibrahimovic terminated the rental company’s lease in 2023, which, according to him, also entailed termination of all tenants; however, the courts have upheld the tenant’s right to remain in the property.
The Rent Tribunal is examining the termination of the tenant.
Consequences
For the tenant: according to his counsel, the judgment means that he receives the same protection as a tenant under a direct lease, increasing his prospects of success before the Rent Tribunal.
For Ibrahimovic and Seger: in addition to the final loss in court, they must pay the tenant’s litigation costs of SEK 422,000.
For the market: the decision confirms that nominee arrangements using rental companies as intermediaries do not protect landlords from subtenants being granted the status of tenants under direct leases.
The rental company and the other tenants in the building who were given notice in 2023 may be affected by the same assessment, but the material does not describe their proceedings.
What happens next: the dispute before the Rent Tribunal, where the tenant has been given notice, remains pending.

Lobby register to be introduced next yearCopy link
The issue of a lobby register has been debated for a very long time. Tobaksfakta and others working in tobacco prevention have long called for transparency to make any influence by tobacco lobbyists on politics clear. Parliament has now…
Analysis
Correction. The article gives the impression that the obligation applies to “contact intended to influence the preparation or decision in a matter” and therefore that it “will not apply to all contacts”, which is correct but incomplete. It fails to mention that the reporting obligation under Section 4 of the Act (2026:1459) also excludes several categories of communication that are expressly intended to influence: ordinary contacts in administrative matters, participation in government-appointed working groups and inquiries where participation is documented, intergovernmental communication, and contacts with parties represented in the Riksdag or their affiliated organisations. A correct formulation is that the register is not only limited to matter-specific preparatory work, but that some matter-specific influence communication, above all ordinary administrative matters and official working groups, is also exempt from the reporting obligation.
Core issue
The Riksdag has adopted a limited lobbying register, and the legal framework awaiting tobacco lobbyists and other influence actors is an obligation to register and report to Kammarkollegiet, not a comprehensive register of political contacts. The Act (2026:1459) on transparency in communications intended to influence political decisions enters into force on 1 July 2027. The central legal question is therefore who is subject to the notification obligation under Section 4 and what must be reported under Sections 8-9. The decisive point is the definition of influence communication in Section 2: contact with a political decision-maker or their staff for the purpose of influencing the preparation of, or decision in, a matter before the Riksdag or the Government.
Legal assessment
Under Section 3, political decision-makers include members of the Riksdag and government ministers; staff include, among others, political secretaries, employees of the Riksdag Administration, state secretaries, political advisers, and inquiry chairs and inquiry secretaries appointed by the Government.
Under Section 4, legal persons and sole traders engaging in influence communication must apply for registration; communication conducted on behalf of another party must be stated in the report.
Section 5 contains exemptions: among others, sole traders whose principal activity is not communication, public authorities, other states, the EU and intergovernmental organisations, and Riksdag parties and their affiliated organisations.
The reporting obligation under Section 8 does not apply to customary contacts in administrative matters or participation in government-appointed working groups and inquiries where the participation is documented and made public.
Under Section 9, the report must include the subject matters, the names of the relevant decision-makers or ministries/committees, the method of contact and its extent; a person who has only provided advice or support to another party is partly exempt from the duty to provide information.
A person who has not engaged in any influence communication during the period must nevertheless state this in the report under Section 10, creating an ongoing reporting obligation even in the absence of activity.
The criticism from the Green Party’s Annika Hirvonen regarding a comprehensive register, including party-political agreements such as the Tidö Agreement and the January Agreement, was not accepted; such informal influence without a link to a specific matter is not covered by Section 2.
Consequences
For the tobacco industry and its trade associations, the Act means that contacts with the Riksdag and the Government Offices in matters such as tobacco advertising rules will be publicly reported through Kammarkollegiet.
Organisations such as Tobaksfakta will gain a tool for scrutinising the influence of tobacco lobbyists, but only within the limited field covered by the Act.
Companies and industry associations will need to establish procedures for documenting contacts and submitting periodic reports; missed deadlines risk being detected by supervisory review.
The material does not state what sanctions apply for failure to register or report; this is not apparent from the cited provisions.
Next step: the Act enters into force on 1 July 2027; thereafter, Kammarkollegiet, as supervisory authority, is expected to establish the registration system, and the first reports will be submitted in accordance with the reporting periods specified in Section 8.

Woman attacked while jogging - man charged with aggravated rapeCopy link
The woman was out for an evening jog when she was suddenly attacked and dragged into some bushes by an unknown man. A homeless man has now been charged with aggravated rape. "He held me by the neck. I couldn't breathe," the woman told…
Analysis
For aggravated rape, the penalty is imprisonment for not less than five and not more than twelve years; for less aggravated rape, not less than six months and not more than four years.
Attempts are punished under Chapter 23 of the Swedish Penal Code, with Chapter 6, Section 15 referring to the attempt provisions for rape and aggravated rape.
Core issue
A 37-year-old man is awaiting trial in the district court, where the central issue will be whether the act on Ribersborgsstigen on 15 July was completed or remained an attempt. He is charged with aggravated rape under Chapter 6, Section 1 of the Swedish Penal Code, but admits only attempted aggravated rape. The distinction between a completed offence and an attempt is the core of the proceedings, as it determines both the sentencing range and the assessment of whether the offence is aggravated.
Legal assessment
The prosecutor must prove that the man completed the sexual assault; the woman’s interview statements that he pulled off her shorts and that she realised he was going to rape her form the basis of the charges alleging a completed offence.
Aggravation is assessed under Chapter 6, Section 1 by reference to whether the violence was of a particularly serious nature, whether the perpetrator showed particular ruthlessness or brutality, or whether the victim’s defenceless position was exploited.
The woman’s statements regarding a choking grip around her neck, that she could not breathe, and blows and rough handling are circumstances the prosecutor is likely to rely on for the aggravated classification.
Aggravating circumstances in assessing penal value under Chapter 29, Section 2 of the Swedish Penal Code include the accused having exploited the victim’s defenceless position or difficulty defending herself, as well as great ruthlessness.
For sentencing, Chapter 29, Section 5 applies: the penalty is determined on the basis of the offence’s penal value, taking into account harm and violation under Chapter 29, Section 6.
The man’s admission of attempted aggravated rape and minor narcotics offence may affect sentencing; his denial of the principal charge means the court must determine the evidentiary issue.
Two witnesses who heard screams and blows and alerted the police, after which the man was apprehended in the act, constitute central evidence in addition to the woman’s account.
The indictment also includes violent resistance, which the man denies and calls a conspiracy; he admits a minor narcotics offence.
The material contains no precedent directly resolving this evidentiary issue.
Consequences
If the man is convicted of completed aggravated rape, he faces imprisonment within the range of five to twelve years; if the offence is assessed only as an attempt, sentencing is under Chapter 23, starting from the same sentencing range but with the possibility of a lower sentence.
If the act is assessed as less aggravated, the sentencing range falls to imprisonment from six months to four years.
The charge of violent resistance may result in an additional penalty, which will be captured in the combined sentencing assessment under Chapter 29.
In practical terms, the outcome primarily concerns the accused, who risks a multi-year prison sentence, and the complainant, whose interview statements form the evidentiary foundation.
The next step is the main hearing in the district court, where the court will determine whether the offence was completed.
