Tenants Pay the Price When Rent Negotiations Stall Copy link
No one benefits when rent negotiations drag on. Tenants need to know what rent applies, property owners need to plan their operations, and the housing market needs stable rules. Yet late decisions and retroactive rent increases have become…
Analysis
Under Section 24 of the Rent Negotiation Act, the landlord and the tenant are entitled to apply to the Rent Tribunal for amendment of the lease terms in respect of the matters covered by the negotiation.
Decisions of the Rent Tribunal under the Rent Negotiation Act may be appealed to the Svea Court of Appeal within three weeks pursuant to Section 31 of the Rent Negotiation Act.

Core issue

For tenants in Värmland, the practical consequence is proceedings before the Rent Tribunal or an arbitrator, since the parties to the negotiation framework have failed to reach agreement. This means that the rent will be determined by a third party, and that the decision may arrive long after the beginning of the year. The core of the news item is that the procedure lacks mandatory time limits, which, according to the opinion article, means that protracted negotiations have no consequences for the parties. The precise legal issue is what avenues are available when negotiations under a negotiation framework have ended without agreement. The decisive legislation is the Rent Negotiation Act (1978:304) and the Act (1973:188) on Regional Tenancy Tribunals and Rent Tribunals. The same right applies if the negotiation was impeded by circumstances not attributable to the party requesting the amendment.

Legal assessment

The parties’ position is regulated as follows:

  • A negotiation framework entails an obligation for the landlord, on its own initiative, to negotiate rent increases under Section 5 of the Rent Negotiation Act, and, upon request, to negotiate lease terms, the condition of the apartments, and common facilities.
  • The Rent Tribunal examines matters under the Act pursuant to Section 30 of the Rent Negotiation Act; a property owners’ organisation or tenants’ organisation is not a party in proceedings under Section 22.
  • Under Section 11a of the Act (1973:188) on Regional Tenancy Tribunals and Rent Tribunals, in a rent dispute the tribunal may not examine a landlord’s claim for higher rent unless negotiations under the negotiation framework have taken place concerning the disputed issue.
  • The arbitrator is appointed and removed by the Rent Tribunal, and the arbitrator’s procedure is governed by the Act (2022:1657) on Dispute Resolution within the Framework of Certain Collective Rent Negotiations, pursuant to Section 23c of the Rent Negotiation Act.

The procedure before the tribunal may be simplified: where there are a large number of similar disputes between a landlord and its tenants, the tribunal may, after examining test cases, determine the remaining disputes without a hearing pursuant to Section 15 of the Act (1973:188). The material contains no case law in the form of decided cases.

Consequences

For tenants: continued uncertainty as to what rent applies, with a risk of retroactive increases once the decision is issued.

  • For property owners: uncertain revenues during large parts of the year, making it more difficult to plan operations, maintenance, and investments.
  • For the parties jointly: the next step is an application to the Rent Tribunal under Section 24 or referral to an arbitrator; the opinion article calls for a statutory right for landlords to refer disputes to an arbitrator without special agreements and with a limited negotiation period.
  • Follow-up: the material gives no date for when the tribunal or arbitrator is expected to decide the Värmland matter.

Analysis

Core issue

Svenska Postkodföreningen now faces a procedural stage before the Patent and Market Court: the company must respond to the Consumer Ombudsman’s statement of claim, in which the Ombudsman seeks an injunction against a single Instagram advertising film, subject to a conditional fine. The matter is not governed by consumer-law rules on misleading practices, but by the moderation requirement in the Gambling Act, and the Consumer Ombudsman is bringing the case specifically to obtain clarification of case law for social media. The precise legal question is whether the film, featuring raining prize cheques, SEK 101 million in gold-coloured text, and a time-limited half-price offer, is “moderate” within the meaning of Chapter 15, Section 1 of the Gambling Act (2018:1138). That provision requires moderation in the marketing of gambling to consumers and prohibits targeting persons under the age of 18. The Swedish Consumer Agency’s general guidelines KOVFS 2025:2 specify the requirement: marketing must not be intrusive or designed to attract particular attention (section 2.2.1), must not give the impression of greater chances of winning (section 2.2.1.1), and should be factual and balanced, limited to facts about the lottery (section 2.2.2.1).

Legal assessment

The Consumer Ombudsman’s objection is twofold: the film presents the lottery as socially attractive, something everyone ought to participate in, and the time-limited offer creates the impression that buying a ticket is urgent.

  • The assessment is made through an overall evaluation of the presentation, content, and design in the chosen medium, in accordance with section 2.1 of KOVFS 2025:2.
  • The guidelines state that marketing should not contain exhortative messages that may encourage an ill-considered decision to gamble, and that information should be limited to facts presented as objectively as possible.
  • Case law on social media is sparse; in autumn 2022, the Riksdag rejected the bill “A Strengthened Gambling Regulation” on the ground that case law was still being established.
  • The court has shown a willingness to impose substantial conditional fines: in the Consumer Ombudsman’s case against the credit broker Advea, an interim conditional fine totalling SEK 3.5 million was attached to the decision.
  • The Consumer Ombudsman has not publicly requested a specified amount, but refers to Postkodlotteriet’s 2025 annual report, showing lottery revenues of just over SEK 3.5 billion, in support of a relatively high conditional fine.

Consequences

For Postkodföreningen, the issue is a potential injunction against the film, backed by a conditional fine whose level the court will assess by reference to the company’s revenues.

  • A judgment would carry more weight than the Swedish Consumer Agency’s 2025 general guidelines, because court practice binds the entire gambling market.
  • For other licence holders, a judgment on the limitations of the Instagram format — short, visual, and algorithmically distributed advertisements — would have implications far beyond the individual advertiser.
  • The next procedural step is for Postkodlotteriet to respond to the Consumer Ombudsman’s objections before the court.

The dispute between Zlatan Ibrahimovic and Helena Seger has now reached its end. Today it became clear that the couple has been denied leave to appeal in the Supreme Court. In short, the dispute concerned whether the tenant should be…
Analysis
The consequence of such an anti-circumvention analysis is that the tenant has the same rights against Ibrahimovic and Seger as if they had granted the tenancy directly to him.
The Supreme Court has refused leave to appeal and the Court of Appeal’s judgment has therefore become final.

Core issue

Ibrahimovic and Seger have, procedurally, lost the case, even though no court of final instance re-examined the merits. The central legal issue was whether an arrangement between the tenant and a rental company sharing common interests with the property owners should be regarded as a nominee or sham arrangement. If so, the protections under tenancy legislation, namely security of tenure and reasonable rent, apply directly in favour of the tenant against the parties with the real interest. The courts applied an anti-circumvention analysis: where the legal relationship has been used to circumvent provisions favourable to the tenant, the tenant is treated as equivalent to a direct tenant. The material refers to Supreme Court precedent relied on by the tenant, but without a case reference; the specific rules identified in the sources are Chapter 12 of the Land Code concerning security of tenure and lease terms, and the Act (1985:277) on Certain Nominee Relationships, section 8 of which shows that nominee proceedings are brought before the district court in which the nominee is defendant in a dispute concerning ownership.

Legal assessment

The District Court, and subsequently the Court of Appeal, made an overall assessment based on the following decisive factors:

  • A community of interests was found, in relation to the tenant, between Ibrahimovic and Seger on the one hand and the rental company on the other.
  • It was considered reasonable to assume that the legal relationship had been used to circumvent legislation concerning the right to security of tenure and reasonable rent.

The tenant based his claim on Supreme Court precedent and on the allegation that he had paid excessive rent, which he asserted formed part of the nominee arrangement for the benefit of the property owner. The couple unsuccessfully advanced new arguments before the Court of Appeal; the court held that these did not alter the assessment. The effect of the termination notice is therefore, in practical terms, neutralised: the tenant legally stands as a first-hand tenant with the rights conferred by Chapter 12 of the Land Code.

Consequences

Ibrahimovic and Seger can no longer compel the tenant to leave by means of an ordinary termination notice; his security of tenure must be respected as if the agreement had been entered into directly with them.

  • If they wish to remove the tenant, only the routes permitted under tenancy legislation remain available, for example eviction in the event of a material breach of contract, which is not addressed in the material.
  • The issue of excessive rent, namely whether any portion must be repaid, is stated in the material to form part of the tenant’s claim, but the outcome on that issue is not apparent from the news report.
  • For the market, the outcome signals that granting leases through related companies does not displace the protective rules; community of interests and circumvention carry greater weight than the contractual form.
  • The outcome has practical significance for owners who lease through intermediaries: each link in the arrangement is assessed by reference to its overall function, not merely the written contract.

Analysis
Legal question

Whether a subtenant in a nominee arrangement, where the property owner lets the apartment through a letting company as an intermediary in order to circumvent tenancy legislation, may be granted the same rights as a tenant under a primary lease, and how that assessment affects parallel termination proceedings before the Rent Tribunal.

Legal basis

Since the material contains no direct extract from the statutory provisions, the analysis must be based on general principles of tenancy law and the Supreme Court case law on nominee arrangements cited in the article. The starting point is that a sublease normally terminates when the head lease is terminated. However, in a nominee arrangement, where the intermediary has no housing need of its own and merely acts as a proxy for the property owner, the arrangement is treated as a circumvention of the protective rules of tenancy law.

The decisive factor is then the tenant’s actual housing situation: the agreement with the intermediary is equated with a direct primary lease with the party that in fact owns and controls the apartment, entailing full protection against termination and security of tenure. In the present dispute, Stockholm District Court found that Ibrahimovic and Seger had let the apartment through an intermediary and thereby attempted to circumvent tenancy legislation, meaning that the tenant should have the same rights as a tenant under a primary lease. That conclusion was upheld by the Court of Appeal and has now become final, as the Supreme Court refused leave to appeal.

Practical significance

The Court of Appeal’s judgment, now final, is a strong argument in the ongoing Rent Tribunal proceedings in which the tenant has been given notice of termination: because the litigation has established that the tenant is legally to be treated as a tenant under a primary lease, termination by the property owner may be upheld only if it is based on the weighty grounds required for termination of a primary tenancy, which substantially complicates enforcement. For property owners, the lesson is that a nominee arrangement not only risks giving the subtenant primary-tenant status, as here, with litigation costs of SEK 422,000 in the first and second instances, but also that the outcome of a civil dispute will in practice carry decisive weight in subsequent Rent Tribunal proceedings. Anyone letting property through multiple tiers should therefore review whether the intermediary has a genuine housing need of its own, as current case law shows that the courts will look through such arrangements in favour of the person actually living in the apartment.

Lobbying register to be introduced next year Copy link
The issue of a lobbying register has been debated for a very long time. Tobaksfakta and others working in tobacco prevention have long called for transparency to make any influence by tobacco lobbyists on policy visible. Now the Riksdag…
Analysis
Under Section 8, the registered person must submit a report to Kammarkollegiet no later than 1 June for the period January-April, no later than 1 October for May-August, and no later than 1 February for September-December.
Under Section 10, a person who has not engaged in any influence communication during the period must state this in the report; nil reporting is therefore mandatory.

Core issue

As of July 2027, Act (2026:1459) on transparency in communications intended to influence political decisions will enter into force, creating a registration and reporting obligation for those who lobby the Riksdag and the Government. Persons falling within its scope must register with Kammarkollegiet, which is also the supervisory authority. The legal regime awaiting tobacco lobbyists and other influence actors is therefore not a prohibition, but a transparency obligation with fixed reporting periods. The central legal question is which contacts are covered. Under Section 2, influence communication means only contact with a political decision-maker or that person’s staff for the purpose of influencing the preparation or decision-making in a matter before the Riksdag or the Government, in order to promote a particular interest or outcome. Assignments to provide advice or support to someone who has such contact are also covered. Section 3 defines political decision-makers: members of the Riksdag and ministers, as well as staff such as political secretaries, employees of the Riksdag Administration, state secretaries, political advisers, and inquiry secretaries.

Legal assessment

The application of the Act rests on several obligations and exemptions:

  • Reporting under Section 9 must include the subjects of the influence communication, the names of decision-makers or information identifying the ministry, unit, or committee, as well as the principal means of maintaining contact and the approximate extent of the contacts.
  • Where the influence communication has taken place on behalf of another person, this must be stated, together with information about the client under the second paragraph of Section 9.
  • A person who has only provided advice or support to another person need not provide the contact information referred to in points 1 and 2 of the first paragraph. The registration obligation does not apply to all contacts. Under the exemptions in the provisions of Section 4, the Act does not cover ordinary contacts within the framework of administrative matters, participation in government-appointed working groups or inquiries where the participation is documented, contacts within international cooperation or ordinary diplomatic relations, or political parties with mandates or their affiliated organisations. Annika Hirvonen’s (Green Party) criticism was directed precisely at this delimitation: lobbying to have issues included in agreements such as the Tidö Agreement or the January Agreements takes place before the formal process and is therefore not covered, since the Act requires a matter before the Riksdag or the Government. The material contains no case law on the issue.

Consequences

For tobacco lobbyists and other interest organisations, the Act means that every contact intended to influence a specific matter must be documented and reported. Companies and legal persons are subject to the obligation where the contact is made by an employee or representative engaging in influence communication in that capacity, under the second paragraph of Section 2. Organisations working on tobacco prevention, such as Tobaksfakta, receive the tool they have requested, but only for the limited field covered by the legislation, not for informal party-political settlements before a matter is prepared. The public gains transparency through the register maintained by Kammarkollegiet, which is the purpose of the Act under Section 1.
